27 Jul 10 Justification and Approval for Other Than Full and Open Competition 1. This document constitutes justification and approval for other than full and open competition for the acquisition described herein, under the authority of FAR 6.302-1. It is executed on behalf of the 174th FW Recruiting Squadron. 2. The 174 FW proposes to procure by means of other than full and open competition 1/6th and 1/12th Scale Airplane Models, from Dimensional Technologies. Dimensional Technologies is the only company with Proprietary rights on the MQ9 Reaper Design from General Atomics Aeronautical. 3. The purchase is at a cost of $29,920.00 4. Identification of statutory authority permitting other than full and open competition. a. FAR 6.302-1, only one source responsible and no other services will satisfy the Government b. 10 USC 2304(c)(2) 5. Demonstrate that the nature of the acquisition requires use of the authority cited. This procurement is for a purchase order to obtain MQ9 Reaper Aircraft Models. The statutory authority cited is FAR 6.302-1(b)(2), the existence of limited rights in data, patent rights, copyrights, or secret processes; the control of basic raw materials; or similar circumstances, make the supplies and services available from only once source. The 174th FW has recently converted to MQ9 Reaper Aircraft and the Recruiting office has requested the procurement of MQ9 Reaper Aircraft Models to use as a recruiting device. The sole source award is based on information obtained from General Atomics Aeronautical Systems Director of Contracts & Pricing. We obtained a letter from General Atomics Aeronautical (GA-ASI) stating that Proprietary Design rights and a Non-Disclosure agreement would only be given to Dimensional Technologies at this time. If General Atomics Aeronautical were to give these rights to any other company it would cost them a considerable amount of time and money in consulting and specification explanation. General Atomics Aeronautical did offer to resell the model made by Dimensional Technologies for an approximate 10% price increase. Therefore the price is deemed fair and reasonable.
