The Florida Department of Law Enforcement (FDLE) has issued a notice of exceptional purchase for Oral Swab Collection Kits under Solicitation Number FDLE-ITB-2610AD, authorizing non-competitive negotiation based on insufficient responsive bids, as permitted by Section 287.057(6), Florida Statutes. This action replaces and withdraws the prior solicitation FDLE-ITB-2610, and serves as the final posting on the DMS Vendor Information Portal, eliminating the need for further competitive solicitation. The procurement is legally justified due to lack of competition, with no formal evaluation factors, technical specifications, or pricing details provided, as the award will be based solely on negotiation of the best terms and conditions. The place of performance is designated as the state of Florida, and all proposals were required to be submitted electronically through the DMS Vendor Information Portal by the deadline of May 8, 2026. Interested parties may file a protest within 72 hours of the notice posting under Section 120.57(3), Florida Statutes, and failure to file timely or with the required bond constitutes a waiver of administrative review rights. The official point of contact for inquiries is Angela Githens, though communications with this office do not substitute for formal protest filings. No FAR clauses, packaging requirements, inspection criteria, or socioeconomic certifications are included, as the document is purely an administrative notice under state law, devoid of federal contract structure or detailed technical terms.

The Florida Department of Law Enforcement (FDLE) has determined that it is in the State’s best interest that the FDLE proceed to negotiate the purchase of these commodities and services on the best terms and conditions, pursuant to section 287.057(6), Florida Statutes, in lieu of re-soliciting competitive sealed replies. This is not a selection under FDLE-ITB-2610 Oral Swab Collection Kits, which is withdrawn by this notice. This is a notice of an exceptional purchase after receipt of less than two responsive replies, pursuant to section 287.057(6) Florida Statutes. This purchase is excepted by law from the requirements for competitive procurement. Pursuant to section 287.057 (6), Florida Statutes, this is the final posting by the FDLE on the DMS Vendor Information Portal, regarding the FDLE-ITB-2610 Oral Swab Collection Kits. Any person adversely affected by this decision shall file a notice of protest in accordance with section 120.57(3), Florida Statutes. Notice of protest shall be made as required by law within 72 hours of the posting of this decision. Questions to the Official Contact Person shall not constitute formal notice. Failure to timely file a protest or failure to file the required bond shall constitute a waiver of proceedings under Chapter 120, Florida Statutes.
