NOTICE OF INTENT TO AWARD SOLE SOURCE THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Reference Number is F1M3E3JBCHSWS. The 628th Contracting Squadron, 101 E. Hill Blvd., Joint Base Charleston, intents to award a sole source contract for Grounds Maintenance for Joint Base Charleston - Weapon Station (JB CHS-WS). The 628th Contracting Squadron intends to issue a purchase order to Louis Mobile Welding Co., 1464 Remount Road, North Charleston, SC 29406, for the period of two (2) months. This sole source purchase order is for the continuation of services of contract FA4418-13-D-0004. The purchase order will provide the time necessary to implement corrective actions recommended by General Accountability Office (GAO) Sustained Protest and allow the successful transition between Louis Mobile Welding Co. and the follow-on contractor. In accordance with (IAW) FAR Part 5.207(c)(16)(ii), the proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1(a)(2)(ii). This notice of intent to award is not a request for competitive proposals; however responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The justification for the sole source requirements as follows: In accordance with FAR 6.302-1: (1) Agency and Activity: 628 CONS, Activity-628th Civil Engineering Squadron (2) Nature of action being approved: Sole source acquisition. (3) The purpose of this acquisition is to provide all management, tools, equipment, and labor necessary to perform grounds maintenance service to approximately 1,508 acres of land for JB CHS-WS for a period of two (2) months. (4) Justification Rationale: IAW FAR 6.302-1(a)(2) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirement during the GAO protest resolution. Louis Mobile Welding Co. is currently performing under an existing contract and has all employees, tools, equipment, and vehicles in place at JB CHS-WS and is performing under the JB CHS-WS grounds maintenance Performance Work Statement. (5) Demonstration of Unique Qualifications: Louis Mobile Welding Co. is the only firm capable of providing the services described in paragraph (3) above without JB CHS-WS experiencing substantial duplication of cost that are not expected to be recovered though competition. Award to any other firm would also create unacceptable delays in fulfilling the requirements as it would require solicitation, award and the mobilization of a new workforce to begin full performance in less than 15 days which is not feasible for a contract of this size and complexity. (6) Description of Solicitation Efforts: IAW FAR 5.102(a)(1), this notice will be posted on the Government-wide Point of Entry (FedBizOpps.gov), but retained in the contract file to document the rationale for a sole source award. (7) The contracting officer has determined that the anticipated cost to the Government will be fair and reasonable based upon a comparison of the proposed price with prices found reasonable on previous purchases, and with the governments independent estimate. (8) Description of market research: The most recent market research for this requirement, solicitation FA4418-14-R-0012 JB Grounds, revealed HubZone business concerns are most common for the performance of grounds maintenance of acreage required by this requirement. No additional market research was conducted. (9) Other supporting facts: Louis Mobile Welding Co. is the current contractor and any attempt to solicit another source would not be practical or cost effective to the government. (10) Interested Sources: An adequate number of offerors submitted a proposal under FA4418-14-R-0012.. (11) Actions to prevent barriers that may lead to restricted consideration in the future: None at this time. (12) This justification is accurate and complete to the best of the contracting officer's knowledge and belief. Address questions to Terry Harrelson, Contract Specialist, at +1 (555) 000-0000, fax +1 (555) 000-0000, email contact@example.gov , or Tamara Kostos, Contracting Officer, Phone +1 (555) 000-0000, email contact@example.gov .
