AI Contract Overview
The Consumer Product Safety Commission plans to award a sole source contract to Thermo Scientific Portable Analytical Instruments for the repair and maintenance of Thermo Scientific Niton XL3t portable XRF analyzers used to screen consumer products for hazardous elements like lead. These devices are critical to the agency’s mission of ensuring product safety, and repairs must be completed promptly to return equipment to operational use in the field. Under FAR 6.103-1(b), the government asserts that Thermo Scientific is the exclusive manufacturer and authorized service provider for this specialized equipment, making competition unnecessary. The agency has issued a notice to allow any other potential provider to submit written evidence demonstrating their ability to perform the required services, but submissions must be received by 3 PM EST on June 3, 2026, via email to Greg Grayson, the Contract Specialist, with no phone inquiries accepted. All responses will be reviewed, though the government retains full discretion to proceed with the sole source award regardless of submissions. If no viable alternatives are presented, the contract will be negotiated directly with Thermo Scientific.

Full Description
The Consumer Product Safety Commission (CPSC) intends to award a sole source to Thermo Scientific Portable Analytical Instruments, 2 Radcliff Rd, Tewksbury MA 01876 for a repair services agreement on their Thermo Scientific Niton XL3t analyzers. The analyzers are used to screen consumer products for lead and other elements of interest. The equipment must be repaired when needed and returned to the field for operational use. Under the authority of FAR 6.103-1(b), only one responsible source and no other supplies or services will satisfy the agency requirements; the government believes Thermo Scientific is the sole manufacturer, seller, and authorized service provider of the equipment. This notice is NOT a request for competitive quotes; however, any firm that believes it can supply the service may give written notice to the Contract Specialist via email at ggrayson@cpsc.gov, by 3 PM EST on June 3, 2026. SUPPORTING EVIDENCE MUST BE FURNISHED IN SUFFICIENT DETAIL, to the above listed email address, Attn: Greg Grayson, Contract Specialist. NO TELEPHONE REQUESTS. Responses will be evaluated: however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, CPSC will proceed with negotiating a sole source award to Thermo Scientific Portable Analytical Instruments.
