AFSC/PZIOB, on behalf of AFLCMC intends to issue a Sole Source award to Circa Inc. for a UPS battery cabinets with 12 months of service for the battery cabinets. The proposed source, Circa Inc., is the sole authorized distributor for the required products in Oklahoma. The original equipment manufacturer (OEM), Eaton, has confirmed in writing (see attached letter/email) that it does not sell directly and exclusively uses the proposed source for all government sales. Therefore, no other source can provide these supplies with the included cases of emergencies, diagnostics, preventative maintenance, Eaton Technicians require the use of Eaton software to connect to the UPS unit via laptop to troubleshoot, diagnose, update, etc. Eaton does not license or allow third-party usage of their software. Eaton providers their own technicians to perform these services when contracted through one of their Eaton Authorized Representatives. Market research has confirmed that Circa Inc. is the only source for this specific brand-name item.

The Government has determined that Circa Inc. is the only one responsible source and no other supplies or services will satisify agency requirements.


This notice is not a request for competitive proposals. This acquisition is being pursued on a sole source basis under the statutory authority of FAR 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements. Unless stated herein, no additional information is available. Requests for the same will be disregarded. Responsible interested parties may submit a capability statement in which they identify their interest and capability to respond to this requirement, if received within seven calendar days after the date of this publication of this notice. The Government will consider all information received by the response date. A determination by the Government not to compete this requirement based upon responses received as a result of this notice is solely within the discretion of the Government. Contractors are advised that the Government will not pay for any information or administrative costs incurred in response to this notice of intent.
