The Environmental Protection Agency Region III intends to award a sole-source, firm-fixed-price commercial contract to Apex Instruments, Inc. for the maintenance and renewal of an operational fleet of twenty-five APEX Air Pro ambient air monitoring units. The procurement, estimated at 41,000 dollars, includes one-year renewals for twenty-five data starter package subscriptions and one central administrative account, as well as eleven Nitrogen Dioxide and eight Volatile Organic Compounds replacement cartridges. This action is conducted under the authority of RFO Part 13, as Apex Instruments, Inc. is the exclusive North American distribution rights holder and certified warranty service provider for this proprietary hardware and software. The requirement is brand-specific to ensure compatibility with existing proprietary data ingestion and cloud mapping pipelines and to utilize patented hot-swappable Smart Gas Cartridge technology. Selecting an alternative platform would result in operational disruption and the obsolescence of current government inventory. While this is not a request for competitive proposals, responsible sources may submit capability statements, proposals, or quotations to Erin Workman by 4:00 pm EST on November 3, 2026, for the government to determine if competitive procurement is warranted. The contract falls under NAICS code 334513 and PSC code 6630.

Notice Type: Notice of Intent to Sole Source Under SAT

NAICS Code: 334513 – Instruments and Related Products Manufacturing for Measuring, Displaying, and Controlling Industrial Process Variables

PSC Code: 6630 – Chemical Analysis Instruments

Description:

The Environmental Protection Agency hereby gives notice of its intent to award a sole-source, firm-fixed-price commercial contract to Apex Instruments, Inc. (204 Technology Ln, Fuquay-Varina, NC 27526) under the authority of RFO Part 13.

The objective of this procurement is to acquire starter package renewal accounts, administrator renewal account and proprietary, factory-calibrated replacement Smart Gas Cartridges.

Market research has determined that Apex Instruments, Inc. is the North American distribution rights holder, and certified warranty service provider for this specific hardware and software line.  No other standard commercial distributors or authorized third-party resellers exist in the U.S. domestic open market.

The Apex AIR Pro platform is uniquely required to meet agency mission parameters due to its:

  • Patented, hot-swappable "Smart Gas Cartridge" technology that auto-configures without manual field calibration or laboratory downtime.
  • Seamless compatibility with the agency’s pre-existing, proprietary data ingestion and cloud mapping pipelines.

This is not a request for competitive proposals, and a written solicitation will not be issued.

However, in accordance with federal acquisition guidelines, all responsible sources may submit a capability statement, proposal, or quotation.  Any response received within 10 days of publication of this notice will be thoroughly evaluated by the government solely for the purpose of determining whether to conduct competitive procurement.  A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government.  Responses must be submitted to workman.erin@epa.gov no later than 4:00 pm EST on 11/03/2026.

Environmental Sampling and Field Data CollectionThe contract involves the collection of soil, water, air, and sediment samples at emergency and Superfund sites for the purpose of contamination analysis, requiring specialized field operations and adherence to strict environmental protocols. The work is performed under a subcontract arrangement, with the Environmental Protection Agency’s Region 3 Contracting Office as the overseeing agency, and is classified under NAICS code 213112, which pertains to oil and gas well drilling services, though this context applies specifically to environmental sampling activities. Sample collection must be conducted across a variety of potentially hazardous locations, demanding trained personnel, appropriate safety equipment, and precise documentation procedures to ensure data integrity for regulatory and remediation purposes. The contract was posted on July 27, 2026, and the place of performance is not designated to a specific location, indicating that work may occur at multiple sites across the region under EPA oversight.
