The U.S. Department of Energy's Office of Scientific and Technical Information (OSTI) intends to award a firm-fixed price contract exclusively to Professional Project Services, Inc. (P2S) for updating engineering design specifications and drawings related to an HVAC system. This sole source award is justified under FAR 6.302-1(a)(2)(i)(ii), since P2S holds exclusive rights to the previously developed and copyrighted design materials from contract DE-DT0010367, making it impossible for other vendors to modify or verify the existing designs without incurring significant duplication of cost and delay. The contract covers engineering, design, and inspection services needed to support the implementation and installation of the HVAC system, but does not include the actual installation work itself. The associated North American Industry Classification System (NAICS) code is 541330 for Engineering Services, with a size standard threshold of $16.5 million. Although this notice is not a solicitation and no formal request for quotes or proposals is issued, vendors who believe they can meet the requirements were invited to respond by September 20, 2019. Any inquiries were to be submitted by September 18, 2019, with written responses directed to the contracting point of contact at OSTI. Award decisions remain at the sole discretion of the government, provided that the selected vendor is registered in the System for Award Management. The contracting office is located in Oak Ridge, Tennessee, with Tammy Payne serving as the government’s point of contact.

NOTICE OF INTENT TO AWARD A SOLE SOURCE THIS IS NOT A REQUEST FOR QUOTE (RFQ) AND NO SOLICITATION IS AVAILABLE. The U.S. Department of Energy's Office of Scientific and Technical Information (OSTI) intends to issue a firm-fixed award to a single source under the authority of FAR 6.302-1(a)(2)(i)(ii), Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements, to Professional Project Services, Inc. (PS2). The requirement is for updating engineering design specifications and drawings previously provided to the DOE's Office of Scientific and Technical Information (OSTI) under contract DE-DT0010367, awarded to P2S on 9/30/2015. The contractor shall also provide engineering, design, and inspection activities supporting the implementation and installation of the HVAC system for which the engineering design specifications and drawings were developed under contract DE-DT0010367. The engineering design specifications and drawings developed under contract DE-DT0010367 are copyrighted by P2S. As such, no other vendor could make modifications to the existing design and drawings. Procuring the services of another vendor to redo/verify the engineering design specifications and drawings is time and cost prohibitive. Seeking these services via another contractor would result in duplication of costs that could not be recovered over the period of performance for this contract. This award is NOT for the installation of the HVAC system. Therefore, the sole source award to PS2, is in the best interest of the government. The North American Industry Classification System (NAICS) code for this requirement is 541330 Engineering Services. The size standard associated with NAICS 541330 is $16.5 million. This notice of intent is not a request for proposals or quotes. Any vendor who believes it can meet the requirement as stated herein may submit a response, which will be considered only if received by September 20, 2019 by 5:00 p.m. EST. Questions should be submitted no later than September 18, 2019 by 5:00 p.m. EST. Responses to this posting must be in writing and submitted to Tammy Payne at contact@example.gov. A determination not to compete the proposed order based upon the responses to this notice is solely within the discretion of the government. Please note that any prospective offeror must be registered in the System for Award Management (SAM) at www.sam.gov prior to award in accordance with FAR part 4.11.
