AI Contract Overview

The contract establishes a new requirement for the procurement of dry, edible beans for use in USDA International Food Aid Programs. Effective for solicitations issued after August 1, 2010, all dry, edible beans must be 100 percent U.S. origin without commingling with non-U.S. products. This change is based on Agricultural Acquisition Regulation (AGAR) 470.103, which mandates that commodities acquired for international food aid must be produced entirely within the United States. While previous contracts allowed commingled products under certain conditions, this contract shifts to strict identity preservation for dry, edible beans to ensure full U.S. origin. Contractors are required to maintain inventory that clearly identifies the beans as originating exclusively from the United States, and government quality assurance inspections will be conducted to verify compliance in line with Federal Acquisition Regulation Subpart 46.4. Failure to meet these requirements could result in noncompliance with contract terms. The solicitation number is AG-IPD-Notice-10-001(NAICS-424510) and contracting officers Susan Champion and Robert Buxton are points of contact for further information.

Pursuant to Agricultural Acquisition Regulation (AGAR) 470.103(a), commodities and the products of agricultural commodities acquired by USDA for use in International Food Aid Programs must be products of the United States, and shall be considered as such, if grown, processed, and otherwise prepared for sale or distribution, exclusively in the United States. Further, AGAR 470.103(c) states that when a product is commingled with product not of the United States, all commingled product shall be considered to be a product of the United States, if a contractor's inventory at the time of contract award or during performance of a contract contains a sufficient quantity of product that was produced in the United States to fulfill the contracted quantity. Contracts to purchase dry, edible beans previously allowed contractors to provide commingled products in performance of contracts for international food aid programs pursuant to subparagraph (c) of AGAR 470.103. AGAR 470.103(c)(2) states, "To the extent the Department has determined a commodity is one that is generally commingled, but is also one which can be readily stored on an identity preserved basis with respect to its country of origin, the Department may require that the commodity procured by the Department shall be of 100 percent United States origin." This notice is to inform prospective contractors that, effective with solicitations issued after August 1, 2010, in procuring 100 percent U.S. origin agricultural commodities for use in international food aid programs (as required by 7. U.S.C. 1732), any dry, edible beans purchased shall be 100 percent U.S. origin product without commingling. Prospective contractors are cautioned that they must identity preserve any dry, edible beans delivered under contracts for international food aid. Government contract quality assurance inspections, performed pursuant to Federal Acquisition Regulation Subpart 46.4 requirements, will be used to verify compliance with this new requirement.

Updated Master Invitation for Bids for International Commodity Procurements (MIFB-I)
Solicitation # 12-3J14-Notice-26-019
The Updated Master Invitation for Bids for International Commodity Procurements (MIFB-I), solicitation number 12-3J14-Notice-26-019, is issued by the USDA Agricultural Marketing Service (AMS) Commodity Procurement Program. Effective August 28, 2026, this master framework governs the solicitation and award of firm-fixed-price contracts for various commodities supporting international food assistance programs, including Food for Peace, Food for Progress, and the McGovern-Dole Food for Education programs. All procured commodities must be products of the United States and comply with specific technical specifications, the Food Safety Modernization Act, and Coalition of Northeast Governors packaging legislation. Bids are submitted electronically via the Web Based Supply Chain Management (WBSCM) portal, with a response deadline of February 27, 2027. Awards are primarily based on the lowest landed cost for immediate delivery or total cost for store delivery, with a 5 percent price preference available for qualified HUBZone small businesses on up to 20 percent of the total volume. The government reserves the right to perform quality assurance at the source and will use past performance from the previous three years to determine contractor responsibility. Contract administration requires electronic invoicing through WBSCM, where Advance Shipment Notices serve as requests for payment, typically due 30 days after receipt of a proper invoice. Performance for bulk grain shipments must occur at federally or state licensed warehouses on the Commodity Credit Corporations authorized list. Contractors must adhere to strict federal anti-discrimination laws and DEI compliance standards, and they are subject to higher-level quality management systems monitored by the Federal Grain and Inspection Service.
