Description: The Department of Homeland Security expects employers to abide by the immigration laws of the United States and to employ in the United States only individuals who are eligible to work. This Special Notice reminds contractors and subcontractors subject to the Federal Acquisition Regulation (FAR), and with contracts containing the clause 52.222-54, Employment Eligibility Verification, that they are required to enroll in and use E-Verify. This clause strengthens long-standing Federal government policy to only contract with businesses and other entities that maintain a legal workforce and employ individuals who are authorized to work in the United States. E-Verify is the means to electronically verify employment eligibility of certain employees working under covered federal contracts. Compliance with FAR Requirements to Enroll and Use E-Verify: The Department of Homeland Security continuously monitors and reviews enrollment in and use of E-Verify by contractors and subcontractors. Effective October 1, 2019, the Department of Homeland Security will begin to provide agency-specific data to Senior Procurement Executives across the government on Federal contractors that are not in compliance with requirements of the clause 52.222-54. This report will allow Senior Procurement Executives to take immediate and appropriate action when a contractor is not in compliance. E-Verify Outreach and Assistance for Federal Contractors and Subcontractors: The United States Citizenship and Immigration Services (USCIS) has enhanced their E-Verify website with resource information and outreach materials to assist with enrollment and use of the E-Verify program. USCIS hosts free public webinars on E-Verify and has a detailed E-Verify guide specifically for federal contractors. Contractors and subcontractors may also contact the E-Verify customer service hotline at 888-464-4218 for assistance with enrollment or use of the E-Verify program.
