AI Contract Overview

The contract pertains to the Electric Laser on a Large Aircraft (ELLA) program, which involves a highly complex collaboration among multiple government agencies and private industry partners. Due to this complexity, the government emphasizes early identification and management of potential Organizational Conflict of Interest (OCI) issues in accordance with Federal Acquisition Regulation (FAR) parts 9.502 and 9.504. To address these concerns, the Acquisition Strategy Team (AST) intends to notify potential offerors about the applicability of specific OCI provisions and clauses in upcoming solicitations and contract awards, ensuring that conflicts are avoided, neutralized, or mitigated before contract execution. Key OCI provisions anticipated for inclusion in solicitations include the AFMCFARS 5352.209-9003 Potential Organizational Conflict of Interest provision and the AFMCFARS 5352.209-9002 clause with possible alternatives for contracts awarded under this program. Offerors will be required to submit detailed risk mitigation plans within their proposals to address any identified OCI risks. The contracting office responsible for this acquisition is located at Kirtland Air Force Base, New Mexico, under the Department of Defense’s AFRL RDK office, with designated points of contact available for further inquiries. This proactive approach aims to maintain program integrity and compliance throughout the ELLA contract lifecycle.

Full Description

Federal Acquisition Regulation (FAR) 9.502 and 9.504 require the identification and evaluation of potential OCI issues in order to avoid, neutralize, or mitigate significant potential conflicts prior to award. The Acquisition Strategy Team (AST) has determined that since the program is extremely complex and involves multiple entities, it is in the best interest of the Government to provide the earliest possible notification to potential offerors of the applicability of OCI provisions and clauses under future Electric Laser on a Large Aircraft (ELLA) solicitation(s) and contract(s). The ELLA Program is extremely complex and intermingled with several different Government agencies and private industry. The Government's intent is to incorporate the appropriate Organizational Conflict of Interest (OCI) provisions and clauses (listed below) in the forthcoming/future solicitations and resultant contract awards in support of the ELLA Program. Provision AFMCFARS 5352.209-9003 entitled Potential Organizational Conflict of Interest (AFMC)(JUL 1997) will likely be in solicitations; and all contracts that are awarded for the ELLA Program will potentially contain clause AFMCFARS 5352.209-9002 (AFMC)(AUG 2002) Organizational Conflict of Interest, with one or more alternatives. Detailed risk mitigation plans will be required in the forthcoming solicitation as part of an offeror's proposal package.

TACTICAL Broad Agency Announcement (BAA)
Solicitation # FA9451-24-S-0001
The TACTICAL Broad Agency Announcement (BAA FA9451-24-S-0001) is a five-year research initiative managed by the Air Force Research Laboratory Directed Energy Directorate. The program seeks innovative, cost-effective solutions to advance directed energy technologies, focusing on computational development, validation of weapon system components, and the improvement of performance, reliability, and affordability. With an estimated total funding profile of 499 million dollars over five years, the program covers 14 diverse topic areas, including laser sources, beam control, satellite custody and characterization, artificial intelligence for space domain awareness, and high power electromagnetics. This BAA utilizes a closed call process, meaning proposals are not submitted to the overarching announcement but in response to specific calls issued via SAM.gov. These calls define the technical requirements, performance periods, and funding for individual efforts. The government may employ various contract types, such as Firm Fixed Price or Cost-Plus-Fixed-Fee, though cost-reimbursable awards require a DCAA-approved accounting system. To streamline solicitation, the program utilizes Topic Area Groups (TAGs), where technically qualified members are identified through the review of executive summaries and are prioritized for future requests for proposals or white papers. Evaluation is conducted through a peer or scientific review process based on overall scientific and technical merit, with cost analyzed for realism and reasonableness after a source is selected. Offerors must be registered in SAM.gov and comply with strict security and program protection requirements, including the submission of security questionnaires and senior personnel profiles. All invoicing and receipt processes for resulting awards are required to be managed through the Wide Area Workflow (WAWF) system.
