This announcement constitutes a Notice of Proposed Contract Action. The Office of AFLCMC/WNKAC intends to award a contract for 60 days in support of Centrifuge Time and Altitude Test Set maintenance, for the T-38 aircraft. This requirement is for the procurement of services for the repair of Centrifuge test equipment, which is used to test the automatic backup unit, the Barostatic time Release Unit, and the Time Delay Unit, which requires maintenance in support of the US16T ejection seat. This contracting effort is sole source to Martin-Baker Aircraft Company Limited, Cage Code U1604. The proposed period of performance starts 03 Feb 2020 up to 02 Apr 2020. Martin Baker is the sole proprietor of the data and holds the licenses required to complete this effort without experiencing a service gap in combat readiness. Maintenance of Centrifuge Test Equipment requires software which is proprietary to Martin-Baker. The government does not own the data rights for the system, therefore the government intends to award through 10 U.S.C 2304(c)(1) as implemented by FAR 6.302-1. In accordance with Statutory Authority of 10 U.S.C.2304 (c)(1), as implemented by FAR 6.302-1. "Only one responsible source and no other supplies or services will satisfy agency requirement." The proprietary property is not available from the Government to be provided for this procurement. The applicable NAICS code is 488190. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. However, a determination by the Government not to compete with this proposed contract based upon responses to this solicitation is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. This solicitation is being issued pursuant to the procedures at FAR 12.603- Streamlined Solicitation for Commercial Items, FAR 13, Synopsis FAR 5.101(a)(1) and Solicitation Number FA8529-20-R-0009, is hereby issued as an attachment hereto.
