In the event of medical malpractice, where would a trial be held? A1)Is the contract FP doc going to be a personal service contractor? If so,he/she covered by the AF for liability purposes. If not, they must provide their own malpractice insurance. Either way, if there was an allegation of malpractice it would fall under the Military Claims Act (MCA). A claim would be filed on a Standard Form 95 alleging whatever malpractice the patient believes occurred. This would be investigated by the AF, first by your local Legal office and MDG, followed by my office (Medical Law Consultant) and then it is forwarded to the Military Service who has single service claims jurisdiction for Portugal. I don't know right off hand whether that is the AF or Navy. Either way, that Service will have the authority to deny or settle the claim. Under the Military Claims Act, there is not right or opportunity to pursue the claim in a court of law. It is an administrative process. If the claim were filed by a local national, we would need to consider whether it were an MCA claim or a NATO SOFA claim, but either way, it's still an administrative process with no right to file in court. And you are right about the credentials hearing, it may be triggered by a malpractice claim or allegation but they are two separate things.
