ADVANCE CONTRACT AWARD NOTICE (ACAN)
Title:
Refurbishing Systems Furniture for use in Health Canada Facilities Located in the National Capital Region

1. The Purpose and Explanation of an ACAN
An Advance Contract Award Notice (ACAN) allows Health Canada to post a notice for no less than fifteen (15) calendar days, indicating to the supplier community that a goods, services or construction contract will be awarded to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the minimum requirements identified in the ACAN, the Contracting Authority may then proceed to award a contract to the pre-identified contractor.
2. Rights of Suppliers
Suppliers who consider themselves fully qualified and available to provide the services or goods described in this ACAN may submit a Statement of Capabilities demonstrating how they meet the advertised requirement. This Statement of Capabilities must be provided via e-mail only to the contact person identified in Section 12 of the Notice on or before the closing date and time of the Notice. If the Bidder can clearly demonstrate they possess the required capabilities, the requirement will be opened to electronic or traditional bidding processes.

4. Definition of Requirements or Expected Results
The objective of this contract is to re-use/refurbish/re-configure existing systems furniture into Health Canada’s various facilities in the National Capital Region on an ‘as and when’ requested basis.
5. Minimum Requirements:
5.1 Suppliers who consider themselves fully qualified must demonstrate that they meet the minimum requirements described below:
5.1.1 The Proponent must(at a minimum) be a certified Teknion Dealer capable of delivering certified refurbishing services for Teknion products within National Capital Region (NCR);
5.1.2 The proponent must(at a minimum) present the official statement that their entity is a preferred (by Teknion) supplier for NCR with prices and/or discounts associated with aforementioned status;
5.1.3 The Proponent must(at a minimum) demonstrate that their firm has completed a minimum of five (5) furniture refurbishment project(s) for a minimum total value of $100,000 within the past three (3) years from the closing date of the ACAN (all projects must be of a minimum of $10,000 each);
5.1.4 The Proponent must(at a minimum) demonstrate that their proposed Project Manager assigned for the coordination of the work must have completed a minimum of three (3) panel systems refurbishment projects for a minimum total value of $100,000 within the past three (3) years from the closing date of the ACAN (all projects must be of a minimum of $10,000 each);
5.1.5 The Proponent must(at a minimum) demonstrate that they have a waste disposal facility that has appropriate provincial certification and agreements and provide the documentation which supports the following:
i. Their identified disposal facility retains a valid provincial Certificate of Approval for Waste Disposal issued by the Province where the facility is located.
ii. A copy of the agreement(s)/arrangement(s) in place to accept the waste components and materials from the bidder during the entire duration of the standing offer.
5.1.6 The proponent must(at a minimum) provide a prove that they are in compliance with the following:
i. ANSI/BIFMA e3-2011e American National Standard - Furniture Sustainability;
ii. ANSI/BIFMA x5.9 American National Standard for Office Furnishings – Storage Units, Tests;
iii. ANSI/BIFMA x5.6 American National Standard for Office Furnishings - Panel Systems, Tests;
iv. D523-89(1999) Standard Test Method for Specular Gloss;
v. D4060-01 Standard Test Method for Abrasion Resistance of Organic Coatings by the Taber Abraser.
5.1.7 The proponent must(at a minimum) grant the following workstation refurbishment times:
i. 1 – 20 workstations – 2 weeks;
ii. 21 – 50 workstations – 3 weeks;
iii. Over 51 workstations – 4 – 6 weeks.
5.1.8 The Proponent must(at a minimum) grant a warehouse storage place of 50,000.00 square feet;

Only One Firm is capable of performing the contract.

8. Ownership of Intellectual Property
Health Canada has determined that any intellectual property rights arising from the performance of the Work under the resulting contract will belong to Canada, for the following reasons, as set out in the Policy on Title to Intellectual Property Arising Under Crown Procurement Contracts:
• the Intellectual Property in Foreground Information consists of material subject to copyright, with the exception of computer software and all documentation pertaining to that software
9. Period of the Proposed Contract
The contract period shall be from November 15, 2023 to March 31, 2025 plus one (1) additional two (2) year option period from April 1, 2025 to March 31, 2027.
10. Estimated Value of the Proposed Contract
The total estimated value of the proposed contract including option periods should not exceed $3.75 Million, including all applicable taxes.
11. Closing Date and Time
The Closing Date and Time for accepting Statements of Capabilities is November 14, 2023 at 2 pm EDT.
