Repeal of Monterey Peninsula Airport Ordinance Nos. 308, 309, and 310

The Monterey Peninsula Airport District has issued Ordinance No. 933 to formally repeal three outdated regulations, specifically Ordinances 308, 309, and 310. These repealed ordinances previously addressed airport hours of operation, aircraft altitude regulations, and touch-and-go operations. The action was taken because these regulations were never enforced, were disallowed by the FAA in 1986, and are preempted by federal law under 49 U.S.C. § 40103(a)(1), which establishes FAA sovereignty over United States airspace. This administrative action is intended to clarify the airport's regulatory framework and eliminate obsolete rules without causing any physical changes to the environment or modifications to airport operations. Consequently, the repeal is exempt from CEQA review under California Code of Regulations sections 15061, 15301, and 15378. The ordinance was approved unanimously by the Board of Directors and becomes effective 30 days after its adoption.
