Request for Qualifications Attorney

The Texas State Board of Public Accountancy is seeking qualified attorneys licensed in Texas to provide legal representation in litigation matters before the State Office of Administrative Proceedings, specifically regarding alleged violations of the Texas Public Accountancy Act. Respondents must demonstrate at least seven years of litigation experience, with preference given to those possessing training or education in accounting, attest work, or the Administrative Procedures Act. Proposals must be submitted by June 22, 2026, at 5:00 p.m. Central Standard Time, either as a single printed hard copy in loose-leaf binders on single-sided 8.5 x 11 inch paper or via electronic email with attachments. The selection process is non-competitive and based on demonstrated competence, qualifications, and a fair and reasonable price, with the Board explicitly stating it is not obligated to choose the lowest proposed rate. All selected attorneys must execute the standard attorney contract outlined in Appendix A, which includes specified limits on hourly rates and reimbursable expenses, and must warrant they have no conflicts of interest that could impair their ability to serve the Board’s best interests. Attorneys will be granted access to confidential Board investigation files and are required to maintain strict confidentiality in accordance with Chapter 552 of the Texas Government Code and the Texas Public Information Act, with any breach potentially subjecting them to disciplinary action. Additionally, all work products generated under the contract become the property of the Board, and respondents must certify their good financial standing, absence of bankruptcy, and current compliance with all tax and fee obligations. Professional liability insurance details, including limits, deductibles, and carrier information, must be disclosed. The contract may be extended into the Board’s following fiscal year and may be terminated with thirty days’ written notice without penalty.
