AI Contract Overview
The contract solicitation SPE4A6-26-R-XC44 is for the supply of 4,028 hundredweight (HD) of RIVET, BLIND (NSN 5320-00-005-6256) under a Total Small Business Set-Aside, with a 486-day delivery window after receipt of order. The procurement is structured as an Indefinite Delivery Purchase Order (IDPO) for a five-year base period with no options, capped at a maximum value of $350,000. The contract mandates full compliance with Defense Logistics Agency (DLA) packaging standards, including MIL-STD-2073-1E for preservation and packaging, and MIL-STD-129 for labeling and bar-coding, with no Item Unique Identification (IUID) required per customer request. Technical data associated with the item is subject to export control under ITAR or EAR, restricting access to contractors with approved US/Canada Joint Certification Program status, completed DLA training, and formal DLA authorization. Inspection and acceptance occur at origin, with zero nonconformances required, and quality compliance is governed by tailored higher-level requirements, ASME Y14.5, ASME B46.1, and MIL-STD-1916 sampling standards. The contract incorporates numerous FAR and DFARS clauses mandating safeguards for covered defense information (252.204-7012), cyber incident reporting, prohibition of certain foreign telecommunications equipment and Xinjiang-sourced goods, prompt payment incentives, electronic invoicing via WAWF, and compliance with hazardous materials labeling and safety reporting standards. Contractors must use U.S.-flag vessels for ocean shipments, submit certified ocean bills of lading within 30 days of each shipment, and avoid ozone-depleting substances and mercury except in permitted components. The evaluation process favors past performance, particularly historical quality and delivery compliance, with cost or price weighed equally alongside all non-price factors, making it a trade-off acquisition rather than lowest price technically acceptable. Offerors must be certified small businesses in SAM with a valid UEI and are required to complete all representations and certifications related to size status, socioeconomic designations, and compliance with federal prohibitions on controlled items. Award is contingent on successful submission of required documentation and adherence to stringent export control and environmental compliance protocols.
