This contract action is for the acquisition of services for which the Government intends to solicit and negotiate with only one source under the authority and procedures of Federal Acquisition Regulation (FAR) Subpart 13.106-1(b). The National Institute of Environmental Health Sciences (NIEHS), Office of Acquisitions (OA) intends to award a single source purchase order to Biocare Medical LLC, 4040 Pike Ln, Concord, CA, 94520-1227 for the acquisition of a service agreement for the Biocare Medical IntelliPATH system, SN BCIP01-00256. The required supplies or services can only be acquired from the original equipment manufacturer (OEM) and only the manufacturer is authorized to perform maintenance on the hardware. No third parties have been authorized by Biocare Medical, LLC to perform these services for the Biocare Medical IntelliPATH system. In addition, only Biocare Medical, LLC can provide the highly unique, proprietary software updates used with this system and it is not available from other vendors. The anticipated period of performance will be for a twelve (12) month base period, plus four (4) additional 12-month option periods. The applicable North American Industry Classification System (NAICS) code for this acquisition is 811219 "Other Electronic and Precision Equipment Repair and Maintenance" and a size standard of $20,500,000.00. Biocare is uniquely qualified to service this instrument as they are the original manufacture (OME) of the equipment and parts are only available to Biocare engineers. Additionally, the software that controls the instrument is proprietary to Biocare Medical, LLC. No other vendor can repair or update this software. The service maintenance agreement covers repairs and preventive maintenance of system and computer hardware, as well as Biocare software and instrument upgrades. The required Service Plan also includes labor, application support, parts, and travel. Additionally, this agreement provides for two (2) preventative maintenance inspections scheduled every six (6) months of this agreement. NIEHS will solicit and negotiate directly with Biocare Medical, LLC and no solicitation will be issued. This notice of intent is not a request for competitive proposals or quotations; however, all responsible sources may submit a bid, proposal, or quotation which shall be considered by the agency. Offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government. All interested parties must express their interest and capabilities in writing via email to Teresa.McCall@nih.gov within fifteen (15) days after the date of publication of this notice. No faxed documents will be accepted. If no responsive statements are received within fifteen (15) days, an award will be made to Biocare Medical, LLC.
