AI Contract Overview

This contract solicitation from the Department of Defense, issued by DLA Aviation in Philadelphia, seeks the acquisition of servocylinders under NAICS code 334511. The procurement requires newly manufactured spare parts only, explicitly excluding refurbished, remanufactured, or repaired materials. Offers from sources not approved by the government are considered technically unacceptable. Distributors must provide authorized distributor letters at the time of proposal submission. The contract incorporates various federal and defense acquisition clauses related to item identification, quality requirements, warranty, equal opportunity, cost accounting standards, and payment instructions, among others. Delivery is expected within 90 days for the specified quantities, with a focus on meeting strict quality standards such as AS/EN/JISQ 9100 or equivalent. Special considerations apply to Foreign Military Sales (FMS) portions of the procurement, where items are wholly owned by FMS customer countries and will not enter the U.S. Department of Defense supply chain. As such, the contract waives item unique identification requirements typically mandated for DoD items, as these parts are shipped directly to the customer countries via a domestic freight forwarder. The solicitation is issued under emergency acquisition flexibilities, waiving the usual synopsis due to urgency. Contact information and submission deadlines are clearly defined, with electronic offer submissions preferred over facsimile. This structure ensures compliance with federal acquisition regulations while addressing urgent operational needs for military support equipment.

The following 3 paragraphs are applicable to ONLY the FMS portion of this procurement: NAVSUP WSS Code N2 has determined that the requirements at DFARS 211.274 whichmandates the use of DFARS clause 252.211-7003 "Item Unique Identification and Valuation" in all solicitations and contracts, be deleted from all non-CLSSAFMS spares requirements processed by NAVSUP WSS and DLA-Aviation. The affected parts are wholly owned by FMS customer countries, Are not covered by a Cooperative Logistics Supply Support Arrangement (CLSSA),These same assets will be delivered to the customer country for their sole use. The IUID definition at DFARS 211.274-1 says IUID "is a system of marking, valuing and tracking items delivered to DoD." These spares are non-CLSSA FMS assets and will never be delivered to DoD. The assets are delivered to a domestic U.S. freight forwarder who is under contract by the FMS customer to ship the assets to the country of record. The FMS customer countries retain ownership of their parts throughout the asset's lifecycle. These parts will never be owned by the U.S. Government, and will never be entered into the DoD supply chain. Based on this, there is no need for these non-CLSSA FMS country assets to be specially marked for tracking by DoD. \
