Settlement Agreement SA 202 is an award notice between the Florida Department of Juvenile Justice and Rite of Passage, Inc., dated July 23, 2026. The agreement addresses a payment dispute resulting from the provider exceeding its contracted Intensive Mental Health bed capacity by one youth for a ten day period between April 29, 2026, and May 8, 2026. This oversight occurred when a youth returned to the program after an extended absence, coinciding with the admission of another youth, which pushed the total to 15 beds despite a contracted limit of 14. To resolve the funding gap not covered under Contract 10891, the Department of Juvenile Justice has agreed to pay Rite of Passage, Inc. the sum of 4,596.30 dollars, pending approval by the Chief Financial Officer of the State of Florida. In exchange for this payment, the provider grants a full release of all claims related to this specific capacity overage. Moving forward, Residential Services commitment staff will implement closer monitoring of contracted bed flexibility to prevent similar occurrences.

Full Description

This settlement agreement is necessary because the Provider was over by one youth in their contracted amount of Intensive Mental Health (IMH) beds (15 of 14 beds) for a period of ten days. The oversight occurred when a youth was out of the program for an extended period and the Department admitted another IMH youth. Upon the return of the youth who was away, the program was over their contracted amount of IMH beds which do not flex with other beds in this contract. Because the program was over their IMH population without the funding being stated in Contract 10891, a settlement agreement is needed. In the future, Residential Services’ commitment staff will monitor the flexibility of our contracted beds more closely.
