The Florida Department of Health, Medical Quality Assurance, entered into Purchase Order C62235 with ABLE Physicians Expert Witness for the provision of expert witness services related to legal case reviews from August 8, 2025, through June 30, 2026. A payment dispute arose regarding Invoice 0014 for services rendered between March 13 and March 17, 2026, which was initially rejected due to discrepancies between the service description and the original quote. By the time the corrected invoice was resubmitted on July 9, 2026, the purchase order had expired and funds were nearly depleted, resulting in only a partial payment of 1,975.50 dollars. To resolve the remaining unpaid balance of 3,837.00 dollars and avoid potential litigation, the parties entered into a settlement agreement dated August 4, 2026. This agreement, associated with solicitation SAR07, includes a Best Interest Letter and a formal settlement where the state agrees to pay the final outstanding amount to ABLE Physicians Expert Witness to fully satisfy the vendor's legal claim.

Full Description

On September 2, 2025, the Florida Department of Health, Medical Quality Assurance (Department), issued Purchase Order (PO)# C62235 between the Department and ABLE Physicians Expert Witness (Vendor) for the service period August 8, 2025, through June 30, 2026. PO# C62235 was issued to allow for the provision of expert witness services related to legal case review. On March 31, 2026, the Department received Vendor’s Invoice #0014 totaling $5,812.50 for services provided during the period of March 13, 2026, through March 17, 2026. The invoice was rejected due to service description not aligning with the quote and purchase order. While Invoice #0014 was being corrected, additional invoices continued to be submitted and paid. Once Invoice #0014 was ready for resubmission for payment on July 9, 2026, the PO only had a remaining balance of $1,975.50. A partial payment of $1,975.50 was made against Invoice #0014 via SWDN D70-0002-3364 on July 21, 2026, which depleted all remaining funds on PO. The Vendor is still owed a total amount of $3,837.00 for services provided during the period of March 13, 2026, through March 17, 2026, and captured on Invoice #0014A. However, the Department was unable to pay for these services due to all funding on the PO having already been expended and PO# C62235 having expired before any additional funding could be procured.
