AI Contract Overview
The solicitation is for the supply of a left front hinged skirt, specifically for vehicles identified as Flight 51 and 52 only, under solicitation number 2098996, issued by the Dallas Area Rapid Transit Authority in Texas. All bids must be submitted exclusively through the Bonfire procurement portal using the in-browser BidTable interface, with responses due by May 22, 2026. The contract requires FOB Destination shipping terms, meaning the seller must include all freight costs in the quoted price, and FOB Origin or Prepay and Add terms are not acceptable. Delivery timing is critical, with failure to meet specified delivery schedules constituting default and subjecting the seller to termination and liability for reprocurement costs. The contract is structured as a firm fixed price purchase order with payment terms of Net 30, and invoices must be submitted via email to [email hidden] in triplicate, with one copy clearly marked “Original,” including full purchase order details, quantities, unit prices, and extended totals. Payment will be made 30 days from receipt of the invoice or the order, whichever is later, unless otherwise agreed in writing. Inspection and acceptance occur at the destination, and the seller warrants that all items are of merchantable quality and suitable for their intended use, conforming to all specified drawings, technical requirements, and manufacturer part numbers. The seller must certify compliance with Texas laws prohibiting association with foreign terrorist organizations and boycotts of Israel, and must not include any sales or use taxes in pricing due to DART’s tax-exempt status. Contracts may not be assigned without DART’s prior written consent, and DART retains the right to terminate for default or for convenience. No specific packaging, marking, preservation, or MIL-STD requirements are mandated in the provided documentation, nor are there identified evaluation factors beyond pricing and conformity, suggesting award is likely based on lowest price technically acceptable. No key personnel, security clearances, or option periods are specified, and no official contract value can be determined without access to the BidTable pricing structure.

Full Description
--- **PURCHASE ORDER TERMS AND CONDITIONS** -- All purchase orders are subject to Dallas Area Rapid Transit Authority's Terms and Conditions. The complete PO Terms and Conditions PDF is available for download in the "Supporting Documentation" section below.
**Freight Terms Notice -** Please ensure that all bids/quotes reflect FOB Destination shipping terms with the freight cost included in the overall price. DART does not typically accept FOB Origin or Prepay and Add terms.
**Delivery Terms Notice -** Time and rate of deliveries are of the essence of this order. Seller's failure to deliver at the time and rate specified shall be the basis for rejection and default termination by the Authority (*Dallas Area Rapid Transit Authority*).
**Payment Terms Notice -** All vendors are advised that DART's payment terms are Net 30. Invoices shall be submitted (contact@example.gov) in triplicate (one copy shall be marked 'Original"), unless otherwise specified, and shall contain the following information: purchase order number; item number; purchase order description of supplies, services, or construction; sizes; quantities; unit prices; and extended totals. Unless otherwise specified, payment will be made on partial deliveries accepted by the Authority when the amount due on such deliveries so warrants. *Invoices will be paid 30 days from receipt of the invoice or 30 days from receipt of the order, whichever is later, unless other payment terms have been agreed upon in writing.*
**Termination for Default Notice -** The Contracting Officer may by written notice terminate this order, in whole or in part, for failure of the Seller to perform any of the provisions hereof within the time periods specified. In such event, the Seller shall be liable for damages, including the excess cost of reprocuring similar supplies or services or completing construction; provided that, if (i) it is determined for any reason that the Seller was not in default, or (ii) the Seller's failure to perform is without his and his subcontractor's control, fault, or negligence, the termination shall be deemed to be a termination for convenience under paragraph 12. As used in this provision, the term "subcontractor" and "subcontractors" means subcontractors, vendors, and suppliers at any level.
