Notice is hereby given that the Stillwater Utilities Authority will receive sealed bids for the construction of: FY2025 Water & Wastewater Facilities Projects Task Order No. 2 Volume II Project #25WL03 SUA Bid No. 40-2025 Scope of work to primarily include the following: Controls and partial equipment replacement for the Solids Contact Units (SCUs) at the Stillwater Water Treatment Plant (SUA WTP). Concrete repairs for the Middle and South SCUs at the SUA WTP. Bids will be received electronically only through https://stillwater.ionwave.net until 3:00 PM on Wednesday, November 11, 2026. Bids shall be opened and read aloud at the above stated time for receipt of bids. Bid opening will occur in Room 1112 "B" of the Municipal Building, 723 South Lewis, Stillwater, Oklahoma, 74074. To register for the City’s online bidding portal, visit https://stillwater.ionwave.net. Bids shall be submitted as stated in the Instructions to Bidders. Any bid received by the City Clerk more than ninety-six (96) hours, excluding Saturdays, Sundays and holidays, before the time set for the opening of bids, or any bid so received after the time set for opening of bids, shall not be considered and shall be returned unopened to the bidder submitting same. Bids will be referred to city staff for evaluation. The SUA may award to the "lowest and best responsible bidder". The SUA reserves the right to reject any or all bids or portions thereof and to waive any technicalities in the bidding process. No bid may be altered, withdrawn, or resubmitted within 45 days after the date set for the opening of bids. The documents describing the requirements for this request for bids may be examined at https://stillwater.ionwave.net. Questions regarding the bid package should be submitted through https://stillwater.ionwave.net. Each bidder is required to submit with their bid a guarantee in the form of an acceptable bidder's bond, a certified check, or a cashier's check on a solvent bank in the state of Oklahoma, and in the amount of not less than five percent (5%) of the amount bid. The successful bidder shall execute a contract within 14 days of Notice of Award by the SUA. The successful bidder shall file a performance bond, maintenance bond, statutory bond and certificates of insurance in the statutory amounts for public liability and workers compensation insurance at the time of signing the contract. Any agreement entered into as a result of this invitation to bid shall be construed under the laws of the State of Oklahoma, and the venue for enforcement of the agreement shall be Payne County in the State of Oklahoma. The SUA may issue addenda as may be necessary in the best interest of the public and the City of Stillwater. Addenda may amend the date and/or time for receipt of bids or any specification, item, document, or requirement in the Bidding Documents upon notice to all prospective bidders who signed the sign-in sheet at the Pre-Bid Conference. This project is to be financed by funding from a Congressionally Directed Spending (CDS)/Community Project Funding (CPF) (Community Grants) Water Infrastructure Project pursuant to the FY 2024 Consolidated Appropriations Act (P.L. 117-42) (FY 2024 Appropriations Act). The following requirements and regulations must be complied with. A. “Equal Opportunity in Employment: All qualified applicants will receive consideration for employment without regard to race, color, religion, sex, national origin, age or handicap. Bidders on this work will be required to comply with the President’s Executive Order No. 11246, as amended. The requirements for bidders and contractors under this order are explained in the specifications.” B. “Each bidder must fully comply with the requirements, terms and conditions of the Oklahoma Department of Environmental Quality (DEQ), Small, Minority, Women’s Businesses Requirements including affirmative steps to contract with small, minority and women’s businesses during the performance of this contract. The bidder commits itself to the affirmative steps to contract with small, minority and women’s businesses contained herein and all other requirements, terms and conditions of these bid conditions by submitting a properly signed bid. Requirements are contained in Oklahoma Department of Environmental Quality Guidance and Procedures, DW-700.” C. “All bidders must comply with the Anti-Kickback Act and the Contract Work Hours Standards Act.” D. “Davis Bacon Act wage rules shall apply. All laborers and mechanics employed by contractors and sub contractors on projects funded directly by or assisted in whole or in part by and through the Federal Government shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of Chapter 31 of Title 40, United States Code. The Department of Labor provides all pertinent information related to compliance with labor standards, including prevailing wage rates and instructions for reporting. For more information, please refer to http://www.wdol.gov and http://www.SAM.gov.” E. “American Iron and Steel provisions also apply to projects funded directly by or assisted in whole or in part by and through the Federal Government pursuant to the Safe Drinking Water Act, Section 1452(a)(4), required that all iron and steel products used for a project for the construction, alteration, maintenance or repair of a public water system are produced in the United States.” F. "This project is subject to Build America, Buy America (BABA) Act requirements. The BABA Act requires none of the funds made available for a Federal financial assistance program for infrastructure, including each deficient program, may be obligated for a project unless all of the iron, steel, manufactured products, and construction materials used in the project are produced in the United States. The BABA Act requirement does not supersede the AIS requirement, and both provisions still apply and work in conjunction." G. System for Award Management (SAM) registration is required for all federal infrastructure CDS/CPF Community Grant Applicants and Awardees (Entities, prime contractors, subcontractors, vendors) in order to be awarded contracts by the CDS/CPF program. SAM replaces Central Contractor Registration/Federal Agency Registration, Online Representations and Certifications Application, and Excluded Parties List System. Applicants and awardees are required to complete a one-time free registration to provide basin information relevant to procurement and financial transactions. New Applicants and awardees please go to Sam.gov to complete the registration process. Note: In order to register in SAM, a Unique Entity Identification (UEI) number will be required. A UEI is a 12-character (alpha-numeric) code that uniquely identifies all entities. Any entity registering to do business with the government in terms of contracts or grants and assistance awards is required to have one. Unique Entity IDs are issued by SAM.gov and are a part of an entity’s record in the Entity Information section of SAM.gov. A MANDATORY Pre-Bid conference will be held October 28, 2026 at 9:00 a.m. local time in Room 2073 of the Norman McNickle Municipal Complex, 723 S. Lewis Street, Stillwater, Oklahoma. Anyone desiring to submit a bid is REQUIRED to attend this meeting in person or virtually via the information provided through IonWave. For those attending in person, a site visit will be conducted following the pre-bid meeting.
