The Air Force issued a sole source procurement for nine units of tank lubricating oil, identified under NSN 2840-01-009-4850RV and part number 742285, with delivery required to Tinker AFB, Oklahoma, within approximately 676.5 days after contract award. The solicitation, issued on December 2, 2013, with a closing date of January 1, 2014, references previous purchases made in 2006 at approximately $23,771 per unit from B. H. Aircraft. This acquisition is justified under authority 10 U.S.C. 2304(c)(1) owing to the supplies being available only from Pratt Whitney, the sole source, and involves technology with military or space applications. The government will consider any commercial item offers within 15 days of the notice but reserves the right to proceed without competition, basing award decisions on price, technical merit, and past performance as outlined in the solicitation. The contract emphasizes that the government’s financial obligation is contingent on the availability of appropriated funds and that no payments are due until funds are confirmed. An ombudsman is appointed to address contractor concerns confidentially during the proposal phase, with contact details provided but expressly excluding solicitation requests. All solicitation documents are available electronically via the Federal Business Opportunities website, and direct questions are to be submitted to the designated buyer at Tinker AFB. This procurement falls under the NAICS code 336412, and the overall approach reflects compliance with FAR Part 6.302 for limited source acquisitions in support of Air Force operational requirements.

Nothing in this notice contradicts other restrictions, identified in the synopsis notice or solicitation regarding eligible sources (e.g. if this is a small business set aside foreign sources may not participate as prime contractors but could, if otherwise eligible, participate as subcontractors). Based upon market research, the Government is not using the policies contained in FAR Part 12 (acquisitions of commercial items) in its solicitation for the described supplies. However, interested persons may identify to the contracting officer their interest and capability to satisfy the Government's requirement with a commercial item within 15 days of this notice. Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. While price will be a significant factor in the evaluation of offers, the final contract award decision may be based upon a combination of price, technical, and past performance factors as detailed in the solicitation. The purpose of the ombudsman is not to diminish the authority of the program director or contracting officer, but to communicate contractor concerns, issues, disagreements, and recommendations to the appropriate government personnel. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern.
