Town of Orchard Park - Procurement, Distribution, & Restocking of Standardized, Automated Pickup-Compliant Trash and Recycling Carts

NOTICE TO BIDDERS:   PROCUREMENT, DISTRIBUTION, & RESTOCKING OF STANDARDIZED, AUTOMATED PICKUP-COMPLIANT TRASH AND RECYCLING CARTS Bids shall be received at the office of the Town Clerk in the Municipal Center, 4295 South Buffalo Street, Orchard Park, New York until September 11, 2025 at 10:15 AM (Local Time) at which time they will be opened publicly and read aloud in the Supervisors Conference Room. Each bid must be prepared and submitted in accordance with the Bidding and Contract Documents.  Each bid must also be accompanied by a Bid Security in the form of a Certified Check of the Bidder, Bid Bond, or Bank Check in the amount of 10% the Bid Price made payable to the Town of Orchard Park. All proposals shall be made in full on forms furnished and shall be enclosed in a sealed envelope marked Procurement, Distribution, & Restocking of Standardized, Automated Pickup Compliant Trash and Recycling Carts Bid Enclosed”, and directed to the attention of the Town Clerk of the Town of Orchard Park, Municipal Center, 4295 South Buffalo Street, Orchard Park, New York, 14127. Each bidder's attention is called to General Municipal Law, which requires a bidder's Certificate of Non-Collusion and Waiver of Immunity. Copies of such certificates are part of the Proposal Form and, unless complied with, this bid will not be accepted. Specifications, Proposal Forms and other Contract Documents will be available on SEPTEMBER 8th, 2025 and may be examined at the Office of the Town Clerk of the Town of Orchard Park, Municipal Center, 4295 South Buffalo Street, Orchard Park, New York 14127 between the hours of 8:30A.M. & 4:15 PM, Monday through Friday excluding holidays. Copies of the Contract Documents may be purchased at the office of the Town Clerk of the Town of Orchard Park for $20.00 each set of documents so obtained. In addition, copies of the Contract Documents may be purchased by mail by sending a non-refundable check for $40.00 to the TOWN (which includes $10.00 as non-refundable mailing and handling charge). All checks for purchasing documents shall be made payable to the Town of Orchard Park. The TOWN will not be responsible for full or partial sets of Contract Documents, including any addenda, obtained from other sources. No refund will be made for documents. Any change, addition, or modification to the specifications and plans shall be made by written addenda only, and the TOWN shall not be bound by verbal interpolating. No Bidder may withdraw its Bid within sixty (60) calendar days after the actual date of the opening thereof. The Town of Orchard Park reserves the right to reject any and all bids, specific portions of bids and to waive any informalities. Each bidder shall submit a statement of qualifications, listing prior jobs of similar size and nature, including contact information. The CONTRACTOR shall not assign, transfer, sublet or otherwise dispose of this contract, their right, title, and interest therein or their power to execute without the previous written consent of the TOWN. The CONTRACTOR shall not be permitted to subcontract any part or all of the work to be performed hereunder without first obtaining written approval from the TOWN of the subcontract or subcontractors of their methods and equipment. The TOWN shall have sole discretion of the approval of any subcontract and nothing herein shall require such subcontracts.
