Title: TransUnion Microdata1. Advance Contract Award Notice (ACAN)An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.2. Definition of the requirementThe Office of the Superintendent of Financial Institutions Canada (OSFI) has a requirement for the provision of customized bureau data from TransUnion. The purpose of this Advance Contract Award Notice (ACAN) is to signal the government's intention to award a contract for this service to TransUnion. Before awarding a contract, however, the government would like to provide other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the 15 calendar day posting period.If other potential suppliers submit a statement of capabilities during the 15 calendar day posting period that meet the requirements set out in the ACAN, the government will proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.If no other supplier submits, on or before the closing date, a statement of capabilities meeting the requirements set out in the ACAN, a contract will be awarded to the pre-selected supplier.3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)The Office of the Superintendent of Financial Institutions Canada has a requirement for Transunion to provide customized micro bureau data.Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:Ability to deliver customized trade-, client-, and financial institution level data and analytics to the Office of the Superintendent of Financial Institutions.Own trade-, client- and financial institution level bureau data for the full suite of consumer loan products covering the period 2008 onward.4. Applicability of the trade agreement(s) to the procurementThis procurement is subject to the following trade agreement(s)Canadian Free Trade Agreement (CFTA) OR Canada–Korea Free Trade Agreement (CKFTA)Canada-European Union Comprehensive Economic and Trade Agreement (CETA)World Trade Organization – Agreement on Government Procurement (WTO-GPA)5. Justification for the Pre-Selected SupplierTransUnion owns the credit bureau data it receives and is able to deliver a proprietary trade- and client-level credit database, including the use of data science techniques and customization of current and historical data.6. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".7. Ownership of Intellectual PropertyOwnership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.8. Period of the proposed contract or delivery dateThe proposed contract is for an initial period of two (2) years, from March 6, 2023, to Feb 28, 2025, with the option to extend the contract up to three (3) additional 1-year periods.9.
