AI Contract Overview

The USACE is seeking a class justification and approval to allow contracting officers to use brand name or equal references for interior color and finish selections in construction solicitations. This action eliminates the need for individual justifications on a per-contract basis for projects spanning Fiscal Year 2027 through 2029, with an estimated total cost of 230 million dollars. The brand name references serve as a quality standard and do not limit competition, as contractors may propose equal products subject to the contracting officer's approval. This notice applies to all construction projects involving aesthetic finishes across the Civil Works, Military Construction, and International and Interagency Missions. The projects will be solicited through various USACE districts using appropriate acquisition methods. Interested responsible sources may submit capability statements to Michael D. Hutchens by 4:00 PM Eastern Time on October 9, 2026. This notice is an intent for a class justification and is not a request for proposals.

Full Description

USACE requests a class justification and approval (J&A) for other than full and open competition to allow Contracting Officers to issue solicitations for construction contracts where “brand name or equal” references are necessary to effectively communicate interior color and finish selections. The estimated cost for this class J&A is $230 million, covering projects from Fiscal Year (FY) 27 through FY29.

10 U.S.C § 3204(a)(1) as implemented by the Revolutionary Federal Acquisition Regulation (FAR) Overhaul (RFO) Part 6 and Defense Federal Acquisition Regulation Supplement (DFARS) Class Deviation 2026-O0017, Revision 1. DFARS 206.103-170(c) states “Notwithstanding FAR 6.103-1(d), in accordance with section 888(a) of the National Defense Authorization Act for Fiscal Year 2017 (Pub. L. 114-328), the justification and approval addressed in FAR 6.104 is required in order to use brand name or equal descriptions.”  This class J&A alleviates the need to execute an individual J&A on a contract-by-contract basis when using such descriptions or specifications in accordance with applicable FAR and DFARS sections.  The plans and specifications issued as part of a construction solicitation may include brand name or equal references for architectural finishes that shall be regarded as establishing a standard of quality and shall not be construed as limiting competition to the identified brand.  The Contractor may, at its option, use any product that, in the judgement of the Contracting Officer, is equal to that named in the specifications, unless otherwise specifically provided in the contract.

This Notice of Intent is not applicable to any single project but covers all construction projects for which the designation of finish colors and/or aesthetic is reasonably anticipated.  The funding for these projects encompasses all funds USACE obligates for construction including the Civil Works Mission, the Military Construction Mission and all projects executed by USACE contracting in support of International and Interagency Missions.  The individual projects this J&A covers will be solicited across the USACE districts, using whatever acquisition method is deemed most appropriate for the requirement.  All responsible sources may submit a capability statement which shall be considered by the agency. The submission must be received no later 1600 PM Eastern Time on 9 October 2026 to Michael.D.Hutchens@usace.army.mil. THIS IS NOT A REQUEST FOR PROPOSAL.

Solicitation FN1626-26 is a Request for Proposal issued by Federal Prison Industries (UNICOR) for a single-award, five-year, Firm Fixed Price, Indefinite Delivery-Indefinite Quantity (IDIQ) contract. This requirement is a 100% small business set-aside under NAICS code 238390 for Other Building Finishing Contractors. Key deliverables include engineered floor capacity tests, preliminary and final design drawings stamped by a Professional Engineer, and the application of load rating markings on all racking. Performance is measured by adherence to project specifications and a process-based quality management system, with a requirement for ISO 9001 certification or a documented quality management system for the prime contractor and all subcontractors. Proposals are due by October 9, 2026, at 2:00 PM EST and must be submitted electronically to the designated contract specialist. Evaluation is based on a pass/fail system, with non-cost factors—specifically the ability to meet specifications and relevant past performance within the last five years—weighted as significantly more important than price. Awardees must adhere to strict delivery timelines, with the first order due within 21 days and subsequent orders within 14 days of receipt. All invoicing must be submitted electronically and must reference specific purchase order numbers to be processed.

Market Intelligence - Richmond ARC - CM at Risk
Solicitation # W912QR-CMRISK-RICHMOND-ARC
The U.S. Army Corps of Engineers, Louisville District, is conducting a Request for Information to gather market intelligence for the construction of a 300 Member Army Reserve Center and an Un-Heated Storage building in Richmond, Virginia. The project involves an estimated 56,678 square feet for the main center and 1,217 square feet for the storage facility, with an estimated acquisition magnitude between 30 million and 50 million dollars. The government is evaluating a Construction Management at Risk strategy utilizing an Other Transaction Agreement under 10 U.S.C. 2808a, which is intended for projects involving emergent construction technologies to improve resilience and reduce costs. The proposed execution plan consists of two phases. In Phase 1, a contractor would be onboarded at approximately 90 percent design completion to serve as an expert consultant, helping the Designer of Record finalize the design to 100 percent through value engineering and market data validation. This phase is funded by a fixed-price preconstruction services fee. In Phase 2, the contractor transitions to an at-risk status to execute the construction under a Guaranteed Maximum Price, which includes validated direct costs, a competitively bid target fee, and shared contingency. Interested parties must submit their responses via the designated survey form by October 2, 2026, providing details on their OTA experience, bonding capacity, and feedback on the proposed acquisition strategy.
