This contract involves the procurement of modulating valves under solicitation number SPRPA126QWA92, issued by the Department of Defense's Defense Logistics Agency Aviation office in Philadelphia, Pennsylvania. The solicitation was posted on February 25, 2026, with a response deadline of March 27, 2026. The contract specifies that only newly manufactured spares from government-approved sources will be accepted, with refurbished, remanufactured, or repaired items considered ineligible. For items related to the P-8/P-3 platform, FAA certification documentation must accompany products unless they are commercial items readily available with current certification. The solicitation requires adherence to strict quality standards, referencing AS/EN/JISQ 9100 or equivalent, and includes inspection, warranty, transportation, and security clauses to ensure compliance with applicable regulations. Significantly, the contract addresses unique identification and valuation by excluding certain marking requirements because the parts, designated as Foreign Military Sales (FMS) assets, will remain under ownership by foreign customer countries and will never enter the U.S. Department of Defense supply chain. Alternative processes for delivery and marking are described, recognizing these parts will be shipped by domestic U.S. freight forwarders directly to the respective foreign customers. Other notable provisions include payment instructions aligning with Wide Area Workflow, Buy American and Free Trade Agreement compliance, equal opportunity mandates for veterans and workers with disabilities, and annual representations and certifications. Communication for proposals is to be handled electronically via email, with a primary contact provided for inquiries. Overall, the contract outlines stringent requirements emphasizing product authenticity, regulatory compliance, and proper documentation to support transactions between the U.S. government and its foreign military sales partners.

Other than what is noted for P-8/P-3 Platform, all potential offers shall provide newly manufactured spares only. Refurbished, remanufactured, or repaired material will not be acceptable; Offers for such are ineligible for award. NAVSUP WSS Code N2 has determined that the requirements at DFARS 211.274 whichmandates the use of DFARS clause 252.211-7003 "Item Unique Identification and Valuation" in all solicitations and contracts, be deleted from all non-CLSSAFMS spares requirements processed by NAVSUP WSS and DLA-Aviation. The affected parts are wholly owned by FMS customer countries, arenot covered by a Cooperative Logistics Supply Support Arrangement (CLSSA), thesesame assets will be delivered to the customer country for their sole use. The IUID definition at DFARS 211.274-1 says IUID "is a system of marking, valuing and tracking items delivered to DoD." These spares are non-CLSSA FMS assets and will never be delivered to DoD. The assets are delivered to a domestic U.S. freight forwarder who is under contract by the FMS customer to ship the assets to the country of record. The FMS customer countries retain ownership of their parts throughout the asset's lifecycle. These parts will never be owned by the U.S. Government, and will never be entered into the DoD supply chain. Based on this, there is no needfor these non-CLSSA FMS country assets to be specially marked for tracking by DoD. \
