26-0012 Lead Copper Rule Revision and Improvements Compliance Program

New Braunfels Utilities (NBU) is seeking qualified engineering firms to provide professional services in compliance with the Lead and Copper Rule Revision and Improvements (LCRR and LCRI) for an extensive water system upgrade involving approximately 3,500 lead service line replacements. The project encompasses the development of a detailed Lead Service Line Replacement Plan, creation of a water sampling compliance program including outreach to schools and childcare facilities, public education initiatives, funding strategy reviews, as well as construction management and oversight of the replacement activities. Additional technical and compliance services will support NBU’s adherence to regulatory requirements over the anticipated contract term extending through 2037. The procurement is structured as a Request for Qualifications (RFQ), with responses due electronically by January 15, 2026, through the designated OpenGov portal. Evaluation will be based on a best-value trade-off approach prioritizing project approach (35%), team qualifications (25%), firm history (20%), past performance (15%), and the cover letter (5%), with no cost element considered. The selected firm must demonstrate strong project management capabilities and compliance expertise. Contract terms impose stringent data security protections, including encryption and breach reporting, and require professional liability and workers’ compensation insurance coverage with NBU named as additional insured. The agreement is non-exclusive, allowing NBU to contract separately for similar services. Respondents must comply with Texas Public Information Act provisions and meet certification requirements including Disadvantaged Business Enterprise (DBE) participation where applicable. The contract emphasizes adherence to professional quality standards and regulatory mandates, with NBU retaining responsibility for inspection and acceptance of services.
