AI Contract Overview
This contract is an indefinite-delivery contract for the procurement of approximately 146 units of a cover/access item identified by NSN 5340-00-759-5409, with a maximum contract value of $350,000. The solicitation is set aside for Women-Owned Small Businesses and is issued under the Defense Logistics Agency’s Strategic Acquisition Program Directorate. Delivery is due within 116 days of award, with FOB origin terms, and inspections and acceptances occur at the supplier’s location. The item must be manufactured, packaged, marked, and delivered in strict compliance with multiple military standards including MIL-STD-2073-1E for packaging, MIL-STD-129 for marking and bar-coding, and MIL-STD-130N for identification and asset tagging. All deliveries require electronic submission of a Certificate of Quality Compliance via the iRAPT system and must adhere to hazardous material guidelines per 29 CFR 1910.1200. The use of Class I ozone-depleting chemicals is prohibited, and any substitute chemicals require prior approval unless explicitly authorized by specifications. The contract imposes stringent cybersecurity and export control requirements, including mandatory compliance with CMMC Level 2 for handling Covered Defense Information, implementation of NIST SP 800-171 controls, and adherence to DFARS 252.204-7012 for safeguarding and reporting cyber incidents. Technical data associated with the item is subject to ITAR or EAR controls, restricting disclosure to foreign persons unless the contractor holds a valid U.S./Canada Joint Certification Program authorization, has completed required DLA export training, and received explicit approval to access the data. Contractors must also comply with prohibitions on hexavalent chromium, mercury-containing devices, and items sourced from Communist Chinese military companies, while ensuring all personnel are verified for employment eligibility and are aware of whistleblower rights. Invoicing must be conducted exclusively through the Wide Area WorkFlow system, and payment is governed by accelerated payment provisions for small business subcontractors. The solicitation requires detailed representations regarding size status, socioeconomic certifications, and disclosures related to covered defense telecommunications equipment, with full compliance obligations extending to joint venture partners. Failure to meet any technical, quality, cybersecurity, or regulatory requirement will result in rejection of the offer or non-acceptance of deliveries.
