This is the 6th modification to the synopsis initially issued 16 March 2004 under solicitation number H92222-04-R-0024 for Electro-Optical System/Forward Looking Infrared (FLIR) for use on USSOCOM Combatant Craft. As a result of questions concerning cost and pricing data, the following clarification is provided: a. The information required by RFP Attachment (1) and Attachment (3) are merely prices required for evaluation purposes. b. It is not expected that cost and pricing data will be required. c. However, should circumstances cause the Contracting Officer to determine that price reasonableness cannot be ascertained as by FAR 15.403-3, and then in accordance with RFP clause 5652.215-9010 the Contracting Officer may require the submittal of cost or pricing data. Should that occur, you may at that time request an exemption per FAR 15.403-1(c)(3). Per FAR 15.403-1(c)(3), the Contracting Officer will then determine whether the proposed product meets the commercial item definition in FAR 2.101 and price reasonableness can be determined without cost and pricing data. RFP H92222-04-R-0024: 4.3 VOLUME 3-COST/PRICE PROPOSAL. The offeror shall insert prices for all items/services in Section B of the solicitation completed with applicable firm fixed price or time & material prices. For the time and material labor rates, the offeror shall insert the labor categories and applicable fully loaded labor rates in attachment (1). Finally, the offeror shall complete the Price Evaluation Roll-up Sheet, attachment (3). 5652.215-9002 Separate Technical and Pricing/Cost Proposals (1998) Offerors shall submit separate technical and cost/price volumes. The technical volume shall not contain cost or pricing data. 5652.215-9010 Cost and Pricing Data Not Required (1998) It is anticipated that adequate price competition will be available to determine price reasonableness. In the event that the price reasonableness can not be determined based on adequate competition, the Contracting Officer may require the submittal of cost or pricing data in accordance with FAR 15.403. The RFP response date remains 6 Aug 2004. It is the responsibility of all interested parties to continually monitor the website to stay informed.
