THIS NOTICE OF INTENT IS NOT A REQUEST FOR QUOTES. A DETERMINATION NOT TO COMPETE THE PROPOSED PROCUREMENT BASED UPON RESPONSES TO THIS NOTICE IS SOLELY WITHIN THE DISCRETION OF THE GOVERNMENT. The Department of Veterans Affairs, VISN 02, 561 East Orange, NJ Medical Center, intends to award a firm-fixed-price single source contract to Covidien Sales LLC (DBA: Medtronic) to provide PB980 Ventilator Batteries to add to its existing equipment. This action is conducted under the authority of RFO Federal Acquisition Regulation (FAR) 12.102(a).
The associated North American Industrial Classification System (NAICS) code for this procurement is 335910 Battery Manufacturing, with a small business size standard of 1,250 employees. Market research indicates that Covidien Sales LLC (DBA: Medtronic) is the original equipment manufacturer and sole distributor of these batteries. The batteries are proprietary and no other alternatives or substitutes will function with the PB980 ventilators. Therefore, Covidien Sales LLC (DBA: Medtronic) is the only vendor with the capability to meet the Government s full requirement.
This Notice of Intent is NOT a request for competitive proposals. However, all responsible sources who believe they can meet the Government's complete requirement are encouraged to submit a detailed capability statement. As a result of analyzing responses to this notice of intent, the Government shall determine if a solicitation will be issued. Any prospective contractor must be registered in the System for Award Management (SAM).
The capability statement must be submitted via email to latriece.bruce@va.gov by 12:00 PM Eastern Standard Time (EST) May 08, 2026.
The statement must provide clear and convincing evidence that the interested party has the ability to provide all equipment and services as described.
A determination by the Government not to compete this proposed contract action based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
