65--Medtronics Pulse Generator

This is a notice that the Department of Veterans Affairs intends to negotiate, under the authority of 41 U.S.C. 253 (c) (1), a sole source purchase order with Medtronic USA Inc., 3576 Unocal Place, Santa Rosa, CA 95403, to purchase five (5) each Dual-Chamber Model 5388 External Pulse Generators. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice in conjunction with procedures in FAR Part 13. This announcement constitutes the only solicitation, and a written solicitation will not be issued. This procurement is being conducted in accordance with FAR 6.302 -1, only one responsible source and no other supplies or services will satisfy agency requirements. While there are other models of external pulse generators on the market, mismatched equipment can cause intra-operative delays and compromise patient safety. Procurement of five additional Medtronic Model 5388 pulse generators will ensure standardization with the equipment currently in use at the VA San Francisco Medical Center. Delivery location is VA San Francisco, 4150 Clement Street, San Francisco, CA 94121. This notice is not a request for proposal or a solicitation for offers. The NAICS code is 339113. Provisions and Clauses are those in effect through Federal Acquisition Circular 2005-15. The following Solicitation Provisions/Contract Clauses are applicable: FAR 52.212-4 Contract Terms and Conditions-Commercial Items (Sep 2005), FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (Sept 2006). For the purpose of this clause items (b)16, 17, 18, 20, 24 with Alt I, and 32 are considered checked and apply, and VAAR 852.270-4 Commercial Advertising (Nov 1984).
