65--Notice of Intent to Sole Source Contract, NovaSure Kits

The Southern Regional Contracting Office, Carl R. Darnall Army Medical Center, Fort Hood, TX, intends to award a sole source firm fixed price (FFP) contract to Hologic Limited Partnership, 250 Campus Drive, Marlborough, MA 01752, for the purchase of Ten (10) each NovaSure Kits (each kit contains 3 NovaSure devices with 3 Suresound devices), in accordance with FAR 13.106-1(b)(1). There is a Small Business Administration class waiver for NAICS 339113, FSC 9999. The FSC for this procurement is 6515. IAW FAR 19.102(f)(7), there is no exception to the non-manufacturing rule, therefore, the rule applies. Previously a request for NovaSure Kits was solicited on FedBizOps from 19 June 2013 thru 17 July 2013, only one (1) vendor, Hologic Limited Partnership responded. Hologic Limited Partnership is the only company that can fulfill this requirement. No other company is expected to respond to the requirement. Hologic Limited Partnership, is the sole proprietary manufacturer and does not use distributors or sub-license any portion of the product. Award will be made on or about 16 Sep 2013. The North American Industry Classification System (NAICS) for this requirement is 339113 and the size standard is 500 employees. This notice is neither a request for quotes nor a solicitation of offers; however, all responsible sources may submit a capability statement which shall be considered by the agency. The government shall not reimburse interested parties for submissions of capability statements in response to this notice. A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. No requests for capability briefings will be honored as a result of this notice and any information provided will not be used as part of any subsequent solicitation requirement.
