The U.S. Army Medical Research Acquisition Activity intends to negotiate exclusively with Engineering Acoustics, Inc. (EAI) for the purchase of a hardened SensoryKinetics tactile cueing rehabilitation device, specifically a Force Plate used to support vestibular rehabilitation in physical therapy. EAI holds the patent and trademark for this unique balance platform device and has previously collaborated with the government on its development. They have also conducted clinical data collection and successfully built and tested an initial batch of the product, with FDA 510(k) clearance pending. Due to EAI's proprietary technology and established work on overcoming major technical challenges, the government views them as the sole source capable of supplying this device. This procurement will be a firm-fixed price, noncommercial Purchase Order assigned under North American Industry Classification System code 334510, with a size standard of 500 employees. No competitive solicitation will be issued, but the government invites written responses only from sources that can clearly demonstrate their capability to supply the item, although responses will be used solely to determine if competition is advisable. If no suitable responses are received by the deadline of August 28, 2014, the government will proceed with awarding the contract directly to EAI. The notice emphasizes that prior SBIR contracts and proposals validate EAI’s expertise and the unique position they hold, reinforcing the rationale for sole-source acquisition.

Full Description

This notice announces the intent by the U.S. Army Medical Research Acquisition Activity (USAMRAA) in support of the U.S. Army Aeromedical Research laboratory (USAARL) to negotiate solely (as prescribed in FAR 13.106(b)(1)) with Engineering Acoustics, Inc. (EAI), 406 Live Oaks Blvd., Casselberry, Florida, 32707-3834, for the award of a firm-fixed price noncommercial Purchase Order for a hardened SensoryKinetics tactile cueing rehabilitation device (Product Description: Force Plate). EAI is the only company that can perform this work due to the fact that they hold the patent and Trade Mark on the Sensory Kinetics balance platform device and have already collected data on the clinical use of the tactile cueing device on patients. The Government has had a working relationship with this proposed contractor in the development of the hardened Sensory Kinetics tactile cueing rehabilitation device that supports vestibular rehabilitation in a physical therapy environment. SBIR Phase I contract W81XWH-13-C-0129 was awarded by USAMRAA on 14 May 2013 in the amount of $149,969.38. Additionally, proposal# H141-007-0092 was submitted by EAI on 22 January 2014 in response to SBIR Topic # DHP14-007. A contract has not yet been awarded for this SBIR Phase I contract. The company has also received numerous other SBIR contracts from other contracting agencies (W911NF-11-C-0057; W911NF-12-C-0042). The major technological hurdles have already been overcome through application of proprietary engineering solutions developed by EAI. A first batch of the EAI Force Plate has been built and tested and the U.S. Food and Drug Administration (FDA) 510(k) clearance is pending. As already stated. EAI holds the patent and Trade Mark on the SensoryKinetics balance platform device. Therefore, the Government expects to purchase the Force Plate directly from EAI without competition. The North American Industry Classification System (NAICS) for this requirement is 334510 and the size standard is 500 employees. This announcement constitutes the only notice by the government; a written solicitation will not be issued. All sources that believe they are eligible to provide these items must respond in writing. Responses must be supported with clear and convincing evidence to clearly articulate the ability to provide the items outlined above. A request for documentation will not be considered an affirmative response. This Special Notice of Intent is not a request for competitive quotes. Information received will be considered solely for the purpose of determining whether a competitive procurement is in the best interest of the Government. If no written responses are received by the date listed below, which reflects 15 days after the publication of this notice, the purchase will be awarded without further remark. All questions and responses concerning this notice shall be emailed to Ms. Lisa Zarick at contact@example.gov. Interested concerns must identify their capability in writing to the above e-mail address or by mail to the address listed below no later than 3:00 pm Eastern Time, Thursday, August 28, 2014.
