The Louis Stokes Cleveland Department of Veterans Affairs Medical Center intends to enter into sole source negotiations with Gambro for the supply of portable hemodialysis machines and related services. The procurement includes 16 Phoenix X36 hemodialysis machines, biomedical engineering training for two technicians, battery backup racks and lead batteries for each machine, as well as software to transmit data from the machines to the VA's electronic medical records system, CPRS. This also involves installation, a multi-year software maintenance agreement covering five years, and a software bridge to connect with the CPRS system. This sole source action is justified under FAR 13.106(b), citing access to proprietary information as the reason for limiting competition to a single vendor. However, other interested parties are invited to express their capabilities by a specified deadline, which will be considered solely to determine if competitive procurement is feasible. The contract stipulates that sellers must be authorized resellers capable of supporting the product sales, warranties, and pricing as per manufacturer requirements, with all products being new and covered by original equipment manufacturer warranties. The seller must also provide software licensing documentation upon request to ensure appropriate software use rights.
