Page 1 of 1 The Department of Veterans Affairs, Network Contracting Office 22, is issuing this special notice to inform industry contractors of the intent to execute a Single Source award as prescribed in FAR 13.106-1(b)(i) with Biomerieux, Inc., 100 Rodolphe Street Durham, NC 27712. Prior to soliciting, market research was conducted and concluded that Biomerieux, Inc. is the only manufacturer and sole distributor for reagents that are compatible with the Vidas instrument. Replacing the manufacturer at this time will disrupt patient diagnostic care, delay patient treatment, and will cause exorbitant costs to change the equipment and reagents. Biomerieux, Inc. can meet all VA requirements IAW Far Part 13.106-1(b)(i) Soliciting from a single source. Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). This requirement is to provide for reagents, test kits, and supplies to use with Biomerieux, Inc s Vidas microbiology identification and susceptibility testing instrument. The test regents and the Vidas instrument requires FDA approval and results are critical in determining treatment plans for patient care.
