The Department of Veterans Affairs, Detroit VA Medical Center, intends to award a sole source contract under Simplified Acquisition Procedures for the purchase of 12 Fresenius 2008T Hemodialysis Systems. The contract will be firm-fixed price and awarded to Fresenius USA Inc., located in Waltham, Massachusetts. These machines are essential for filtering waste products from veterans’ blood and are uniquely compatible with the CyberRen Information System used by the medical center, making Fresenius the only viable provider. Based on market research and past procurements, no alternative vendors or equipment meet the technical requirements or integration compatibility needed. The associated NAICS code for this acquisition is 334510, and the estimated value does not exceed the Simplified Acquisition Threshold. Efforts to identify other Service-Disabled Veteran-Owned Small Businesses or substitutes were unsuccessful despite thorough market research via several federal procurement databases. Consequently, the VA has determined that only Fresenius can fulfill this requirement and plans to negotiate solely with them. Responses to this notice must clearly demonstrate why competition would benefit the government and are due by July 20, 2022, with no solicitation packages or telephone inquiries accepted. The contracting officer has certified the justification in compliance with FAR 13.106-1.

LouAnn Gilliland Contract Specialist contact@example.gov DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C250-22-AP-5278 Contracting Activity: Department of Veterans Affairs, VISN 10, Network Contracting Office in Kettering, Ohio has been requested by the John D. Dingell VAMC, Detroit, MI to procure 12 Hemodialysis Machines. The 2237 number is 553-22-3-7730-0108 Brief Description of Supplies/ Services required and the intended use/Estimated Amount: 12 Fresenius 2008T HD SYS. CDX W/BIBAG BLUESTAR with CLIC, which will filter waste products from the veteran s blood. Estimated Cost: Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: No alternative Hemodialysis equipment is available that will meet the needs of the service except Fresenius. Service has CyberRen Information System and only Fresenius Hemodialysis equipment will integrate with the CyberRen Systems. Description of market research conducted and results or statement why it was not conducted: VIP was queried using NAICS Code 334510, which provided 186 SDVOSB/VOSB vendors that could potentially provide this equipment. However, when the key word Hemodialysis was added to the search, it provided no vendors able to provide this equipment. GSA, FPDS, eCMS, and SCMC were all searched for past purchases and/or alternative items and this research was unsuccessful for alternative items. However, a past procurement (36C25022P0935) was discovered and found no substitutes for this equipment and no SB vendors were available to provide this specialized equipment. Therefore, the VA Rule of Two cannot be met with this procurement. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. ____________________________ LouAnn Gilliland Contracting Officer
