The Department of Veterans Affairs, Network Contract Office 10, awarded a firm fixed price purchase order to Derrah Morrison Enterprises LLC for the procurement of a Steris Innowave Sonic Irrigator for the Cleveland VA Medical Center. The award, valued at 32,355.00 dollars and dated April 12, 2023, was executed as a total small business set-aside under NAICS code 339113. This acquisition was necessary to replace an end-of-life Steris Innowave Unity 15 Gal Sonic Irrigator purchased in 2016 that was deemed beyond repair. The procurement was justified as a brand name only requirement to ensure continuity of equipment and to leverage the existing expertise of BioMed Technicians familiar with Steris units. The new system is specifically intended for the sterilization of eye instrumentation and features a smaller footprint that requires no modifications to the existing facility space. Market research conducted via VetCert, GSA, and NAC determined that the item was not available through GSA or NAC contracts and that the VA Rule of Two could not be achieved, leading to an open market solicitation set aside for small businesses.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT Last Updated: 02/01/22 Page 1 of 1 DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C250-23-AP-2181 Contracting Activity: Department of Veterans Affairs, VISN/NCO 10, Cleveland VA Medical Center Transaction number: 541-23-2-250-0144 Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Network Contract Office (NCO 10) intends to award a new, firm fixed price, brand name only purchase order for a Steris Sonic Irrigator. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: SPS Cleveland is requesting replacement for a Steris Innowave Unity 15 Gal Sonic Irrigator purchased in 2016. The system is end of life beyond repair. A new system is needed for the sterilization of eye instrumentation only. The upgraded replacement system from Steris is smaller and the footprint will not utilize the space as current model, thus no modification to space is required. BioMed Technicians are familiar with working on these units by Steris, and it is in our best interest to have continuity of equipment throughout the department. Description of market research conducted and results or statement why it was not conducted: MR conducted via VetCert, GSA, NAC, and internet search. VetCert returned 800 SDVOSB sources using NAICS code 339113 and 0 using business name Steris Corporation. This Item is not available via GSA or NAC contract. An intent to sole source identified multiple distributors. Although the OEM has identified SDVOSB distributors, an exclusive SDVOSB set aside is not permitted. The VA Rule of two will not be achieved for this procurement. Recommendation is open market solicitation as a small business set a side and awarded to the contractor that provides the best value to the government. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. ____________________________ ________________________ Tiera Sims Date Contracting Officer
