The Department of Veterans Affairs, Veterans Health Administration, Network Contracting Office 17, plans to award a firm-fixed price, sole source contract to Becton, Dickinson and Company to supply specific BD Flow Cytometry reagents used at the Audie L. Murphy VA Hospital's Pathology & Laboratory Medicine Service. These reagents are essential for evaluating the immune response in COVID-positive patients, guiding risk assessment and treatment. The contract covers FDA-approved, proprietary reagents compatible exclusively with the Government-owned BD FACS CANTO II instrument. The vendor must maintain continuous inventory, provide next-day delivery as required, and ensure lot consistency throughout the one-year ordering periods over a potential five-year term from July 2022 to June 2027. The contractor is also responsible for prompt communication regarding orders, shipment delays, recalls, or technical alerts, and must be prepared to fulfill emergency orders within 24 hours at no additional cost. This sole source procurement is justified based on the unique compatibility requirement that no third-party reagents meet, with market research confirming Becton Dickinson as the only qualified supplier. The vendor will not perform inherently governmental functions or have access to patient data or VA information systems during contract performance. The services must comply with applicable regulatory guidelines such as those from AABB, CAP, and VA policy. The government retains control over records and any equipment-related data storage, ensuring privacy and security protocols are upheld. Interested parties may submit capability statements within five business days, but absent a viable alternative, the contract will be awarded directly to Becton Dickinson under authority permitting non-competitive sole source procurement.
