The Centers for Disease Control and Prevention (CDC) plans to award a sole source contract to KPL, a small business located in Gaithersburg, MD, for the production and delivery of Bacillus anthracis diagnostic reagents. This contract entails the installation and supply of multiple runs of DFA (direct fluorescent antibody) B. anthracis cell wall and capsule kits, with shipments scheduled for March, May, and June 2008. CDC provides the antibodies in cell culture material to KPL, which is responsible for purifying, conjugating, dispensing, lyophilizing, labeling with CDC-approved materials, packaging, and shipping the final product to CDC. Upon receipt, CDC conducts product testing and compensates KPL for the services rendered, with an agreed waiver of the set-up fee. The contract is awarded without full and open competition due to KPL being the only vendor with a validated, optimized, and custom-designed B. anthracis DFA reagent that is not reproducible by CDC owing to proprietary processes. This sole source justification is supported by the statutory authority under 41 U.S.C. 253(c)(1) and FAR 6.302-1. While the acquisition is not formally set aside for small businesses, KPL qualifies as a small business. Interested parties may express their capability, but this notice does not solicit competitive proposals, and the government retains discretion on competition decisions. Contractual inquiries are directed to CDC’s contract specialists, Gary Morgan and Jeff Miller.
