Federal Prison Industries (FPI), in response to an inquiry from the Department of Homeland Security (DHS), has submitted a "good faith" announcement regarding its intent to manufacture plastic file folders, classified under Federal Supply Classification (FSC) code 7510 for Office Supplies. FPI aims to sell these products competitively to DHS without mandatory source requirements. The contract identifies that plastic file folders fall under SIC code 3089 (Plastic Products, Not Elsewhere Classified), and while FPI has historically produced similar items within these classifications since fiscal year 1989, the company acknowledges that the folders might be viewed as distinct from previously manufactured products. Consequently, FPI seeks public comment on whether plastic file folders should be considered a new product under its guidelines, which affects how the production will be managed. The announcement invites interested parties to submit comments within 21 days, specifically addressing the question of whether the plastic file folders qualify as a new product separate from existing items produced by FPI. Comments related to market impact or share are also welcomed. All feedback will be reviewed prior to FPI’s final decision, with the option for stakeholders to engage with FPI's Board of Directors on related issues at any time. The contract is associated with solicitation number Reference-Number-RACS-22-2005, with the main point of contact being Industrial Specialist Yvette K Hairston-Mercer at the Federal Prison Industries office in Washington, D.C. This process ensures transparency and public participation regarding the expansion of FPI’s production to include plastic file folders for the DHS.

Full Description

Under the provisions of FPI's guidelines process, published March 12, 1997, in the Federal Register and March 25, 1997, in the Commerce Business Daily, FPI submits the following "good faith" announcement for public notice and comment. In response to an inquiry from the Department of Homeland Security (DHS), FPI proposes to manufacture plastic file folders for sale competitively to DHS, without mandatory source. Under FPI's guidelines covering the production of new products and significant expansion of existing products, the primary determinant of what constitutes a "specific product" is an item's Federal Supply Classification (FSC) code. Plastic file folders fall within Federal Supply Classification (FSC) code 7510 - Office Supplies. FPI has recorded sales in this category every year since FY 1989. The most appropriate SIC codes for plastic file folders is SIC 3089 - Plastic Products, Not Elsewhere Classified. FPI has a history of making similar items in the FSC code for plastic file folders. Previously, FPI has produced items in the relevant SIC code as well. For this reason, FPI believes plastic file folders do not meet the definition of "new product" set forth by FPI's guidelines. However, FPI recognizes that a reasonable person may construe this item to be a product separate and distinct from any other made by FPI. Under the terms of FPI's expansion guidelines, interested parties may submit comments regarding this proposed production by FPI. In submitting comments to FPI, the following guidelines will apply: 1) Comments will be due within 21 days of the date of this notice; 2) Relevant comments will focus on and address why plastic file folders should be considered a new product, separate and distinct from a similar item currently produced by FPI; 3) While the primary purpose of the comments will be to determine if the item should be defined as a new product, comments related to market share and/or the impact resulting from such a production decision may also be considered relevant. All comments received in response to this announcement will be considered by FPI. All commenters will be advised when FPI makes a final determination. Any interested party has a right to raise any question at any time with FPI's Board of Directors. All comments should be addressed to: Chief Administrative Officer, Planning, Research, and Activation Branch, Federal Prison Industries, Inc., 320 First Street, NW, Washington, D.C. 20534.
