The U.S. Small Business Administration (SBA) has proposed a modification to the methodology used for calculating the number of employees when determining a business's small size status. Currently, the SBA relies on a rolling average of the number of employees over the past 12 months. The proposed change would replace this with an average based on the number of employees across the three immediately preceding completed calendar years. This adjustment aims to simplify the calculation process, lessen the administrative burden on small businesses, and provide a clearer and more stable definition of small business size standards based on employee count. Stakeholders are invited to review the proposed rule and submit comments by September 25, 2007, either electronically through the Federal eRulemaking Portal or by mail to the SBA's Office of Size Standards. The proposal pertains to businesses under NAICS code 926110 and is managed by the SBA’s Office of Size Standards, with Carl G Jordan serving as the primary contact for inquiries. This regulatory update reflects SBA’s ongoing efforts to refine size standards and improve clarity in small business determinations.

Full Description

The U.S. Small Business Administration (SBA) has proposed to change how it calculates a concern's number of employees in determining its small business size status. SBA currently uses a rolling average number of employees for the immediately preceding 12 calendar months (13 CFR 121.106). SBA's proposal would alter the period from a 12 month rolling average to a firm's average number of employees for its 3 immediately preceding completed calendar years. This proposal will simplify the calculation of the average number of employees, reduce the burden on small businesses, and better define the size of a small business where number of employees is the measure for the size standard. You may read and/or download the proposed rule at http://www.regulations.gov. You must submit your comments to SBA on or before September 25, 2007. Submit your comments, identified by RIN 3245-AF60 in one of the two following ways: (1) Use the Federal eRulemaking Portal: http://www.regulations.gov; follow the instructions there for submitting comments; or (2) Mail/Hand Delivery/Courier them to Gary M. Jackson, Division Chief for Size Standards, 409 Third Street, SW, Mail Code 6530, Washington, DC 20416.

Administrative Lease Authorization and Regulatory Compliance SupportThe California State Lands Commission is authorizing an administrative lease for a 20-year general lease agreement to support public agency use of an existing pedestrian bridge that crosses sovereign lands. This action involves formalizing the long-term operational use of the structure while ensuring compliance with state regulatory frameworks, including a determination of eligibility for a CEQA categorical exemption to avoid full environmental review. The lease pertains specifically to infrastructure already in place and is intended to provide legal clarity and continuity for public access purposes without requiring new construction or substantial modification. The activity falls under NAICS code 926110, indicating it is a government administration function related to land and natural resource management. The project is centered in Red Bluff and is part of a broader effort to maintain public infrastructure on state-held lands while streamlining regulatory processes through established exemptions. The administrative action requires internal review and documentation to confirm that the lease meets statutory criteria for categorical exemption under CEQA, ensuring no significant environmental impact from continued use. No new solicitation or competitive bidding is involved, as the lease supports an existing facility under the jurisdiction of the California State Lands Commission. The contract serves as a procedural and regulatory support mechanism to sustain public access and uphold compliance with state land management policies over the 20-year term.
