The U.S. Department of State plans to award a sole source contract to Thermo Eberline LLC for a one-year service agreement to renew warranty and calibration services for 125 Thermo Identifinder Radioactive Isotope Identification systems. These systems, initially purchased under order SAQMPD04M2548 with a three-year warranty, are nearing the end of their coverage. The Department requires an extended warranty valued at $34,487.50 to maintain crucial service and upkeep of the equipment while deployed in the field. Thermo Eberline LLC is the exclusive provider of maintenance and repair services for this technology due to proprietary rights and the original warranty terms, justifying the sole source procurement under 41 U.S.C. 253 (c)(i) and FAR 6.302-1 regulations. As this is a notice of intent to award without competitive proposals, other vendors wishing to challenge the sole source designation must submit an interest letter explaining their capability to provide equivalent services by January 15, 2008. The Department will evaluate any responses but retains full discretion over whether to open competition. Costs incurred for responding to the notice will not be reimbursed. The point of contact for this procurement is Vincent J Sanchez, reachable via email or phone. This contract addresses warranty renewal services essential to sustaining the operational readiness of sensitive isotope identification instruments used by the Department.

Full Description

The U.S. Department of State intends to issue a Sole Source Award to Thermo Eberline LLC for a one (1) year service agreement to renew warranty and calibration services associated with 125 Thermo Identifinder Radioactive Isotope Identification systems that were originally purchased under order SAQMPD04M2548 from Thermo Eberline LLC. These products were originally under a 3 year warranty at the time purchase however that coverage is almost expired and it is imperative the Department purchase an extended one year warranty in the amount of $34,487.50 to continue service and maintenance of this equipment while deployed out in the field. Due to the technology installed in the detectors which Thermo manufacturers, this vendor is the only source of maintenance and repair of the units referenced above based on products rights and the original warranty agreement. The statutory authority permitting other than full and open competition is 41 U.S.C. 253 (c)(i). The regulatory authority is FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. This is a notice of intent to award a sole source procurement action and is NOT a request for competitive proposals. Firms who want to challenge the sole source must submit an interest letter that demonstrates your firm's ability to provide an equivalent supply as described above. Interested parties must provide rationale as to why they should be considered. All interested firms must respond to this notice by 15 January 2008, 12:00PM EST. to the point of contact listed below. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion for the Government. The U.S. Department of State will not reimburse for any costs associated with providing the capability information.
