The purpose of this notice is to locate sources to enter into a Basic Ordering Agreement for Air Show Broadcast Services with the 99th Contracting Squadron, Nellis Air Force Base. A draft of the Performance Work Statement is included in this notice. A basic ordering agreement is not a binding contract. However, any resultant Task Order is contractually binding. Scope of Requirement: Provide Air Show Broadcast Services in accordance with the Performance Work Statement. All proceeds from the sale of advertisements for the broadcasts belong to the Broadcaster, who agrees to look exclusively to such advertising sales for all broadcasting costs and profits, if any. The Broadcaster agrees to bear all costs and expenses of producing the broadcast. It is expressly agreed that neither the United States, the commander, his or her representatives and successors, nor Nellis Air Force Base shall be liable for any expenses or obligations incurred in producing these broadcasts. No appropriated funds of the United States shall become due or paid to the Broadcaster by reason of this agreement. The Broadcaster shall not be required to pay money to Nellis AFB, or to provide goods, services or considerations not directly related to producing the broadcast. Neither the Broadcaster nor his advertisers are required to enter into any commercial sponsorship agreements to be included in any on-site, Internet/Mobile broadcasts. Additionally, Force Support Squadron may not offer commercial sponsors free advertising within the broadcast. This does not prevent commercial sponsors from purchasing advertisements from the Broadcaster, nor does it prevent Force Support Squadron partners from being mentioned in public address announcements which will air live during the broadcast. Finally, the Broadcaster and Force Support Squadron are welcome (but not required) to work together to enhance benefits for their respective clients. Force Support Squadron is responsible for any on-site presence items requested outside the broadcast (i.e. non-screen wrap signage, booths, etc.) and the Broadcaster or advertisers must enter into a commercial sponsorship agreement to take advantage of these items. All responsible sources may respond to this issuance. The North American Industry Code for this service is 519130 (Internet Publishing and Broadcasting). Provide at least the following information in responses to this notice: 1) Statement of Capabilities/Qualifications 2) Statement of Understanding that consideration is in the form of revenues raised and that the Government will not pay money for the requested services in accordance with section 6 of the Performance Work Statement. 3) Cage Code, DUNS Number, and Contact information of interested sources. Interested vendors may submit the requested documents to the identified point of contact not later than 08:00 AM (Pacific Standard Time) on 18 August 2010. Responses provided to this sources sought notice shall be evaluated solely for the purpose of market research. A determination by the Government not to compete this requirement on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications ARE NOT acceptable responses to this notice. Sources shall include in their information: statement of capabilities and qualifications to perform the requested services, point of contact information, company name, business size, and cage code.
