Axway software licenses and maintenance support

The U.S. Food and Drug Administration intends to negotiate and award on a sole source basis to Axway, Inc, under the authority 41 U.S.C. 253(c) (1), as set forth in FAR 6.302-1. This acquisition is to provide Axway software licenses and maintenance support currently being used for the FDA's Electronic Submission Gateway (ESG). The Food and Drug Administration (FDA) Electronic Submissions Gateway (ESG) is an Agency-wide solution for accepting electronic regulatory submissions. The FDA ESG enables the secure submission of regulatory information for review and enables the FDA to process regulatory information automatically, functioning as a single point of entry for receiving and processing all electronic submissions in a highly secure environment that complies with secure Hypertext Transfer Protocol (HTTP) messaging standards and uses digital certificates, including electronic acknowledgement of submissions. The electronic submission process encompasses the receipt, acknowledgment of receipt (to the sender), routing, and notification (to a receiving Center or Office) of the delivery of an electronic submission. The purpose of this requirement is to provide licensing and software support for the Axway Gateway products used in FDA's ESG. This includes providing product upgrades and patches, as well as assisting with analysis of suspected errors in the Axway products. The period of performance for the annual maintenance is one year with up to 4 one-year option periods. This requirement is currently being provided by Axway, Inc. and there are no resellers or 3rd parties that can provide these licenses. There are no other sources that can provide maintenance for this software. The NAICS code is 511210 and the size standard is $25M. This notice is not a request for competitive quotations. However, any firm that believes it can meet these requirements may submit a written response via email to Veronica Dhaness at the email address below by 2:00 PM Eastern Time on May 22, 2012. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the above requirement. Information received will be considered; however, a determination by the Government not to compete the proposed acquisition based on responses to this notice is solely within the discretion of the Government. If no responses are received, the FDA will proceed with the sole source award to Axway, Inc., 6811 E Mayo Blvd., Suite 400, Phoenix, AZ.
