AI Contract Overview
The contract specifies the procurement of a non-spillable battery, storage type, identified by NSN 6140-01-371-0519, sourced as a commercial off-the-shelf item from approved manufacturers including BATTERY OUTLET, INC. and ENERSYS DELAWARE INC. with part numbers NPX-25, NPX-25FR, and NPX-25TFR. Each battery must comply with 49 CFR § 173.159a, requiring secure packaging in strong outer containers, protection of terminals against short circuit, and durable marking as “NONSPILLABLE” or “NONSPILLABLE BATTERY” on both the battery and its outer packaging, which exempts it from standard hazardous material shipping documentation and labeling requirements. The item is classified as a critical application with a Type I (Code H) shelf life of 12 months that is non-extendable. Packaging must follow MIL-STD-2073-1E with Pack Code U, and palletization must adhere to RP001 DLA Packaging Requirements. Marking is required per MIL-STD-129 with special requirements identified by code ZZ. The contract prohibits the intentional addition of mercury or mercury compounds, except as functional components in batteries or other explicitly permitted applications under NAVSEA guidelines, and mandates a secondary containment boundary for any mercury-containing components. The solicitation requires firm fixed pricing with zero variance in quantity, inspection and acceptance at origin, and delivery within 60 days after order. Shipment must be via freight using the fastest traceable method; parcel post is prohibited. Deliveries are directed to two U.S. Navy vessels — USS ESSEX LHD 2 and USS PAUL IGNATIUS (DDG-117) — using VSM for DLA vendors. Sampling follows MIL-STD-1916 or ASQ H1331 Table 1 using zero non-conformance acceptance criteria, with attributes assigned verification levels VII, IV, and II for critical, major, and minor characteristics respectively. The contract incorporates mandatory clauses related to hazardous materials, cybersecurity, whistleblower protections, antiterrorism training, electronic payment via WAWF, and compliance with export control and supply chain restrictions. Offerors must have current representations in SAM, including certifications on covered telecommunications equipment, foreign ownership, and restricted business operations in Sudan. Contract administration is managed by DLA Land and Maritime, with payment processing
