Bonneville Powerhouse 1 and Powerhouse 2 Oil Storage Room Fire Protection

This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions." U.S. Army Corps of Engineers, Portland District intends to solicit a firm-fixed price construction contract to replace the existing CO2 fire suppression systems in the Bonneville oil storage rooms. The oil storage rooms are located at Bonneville Lock and Dam Project in Bonneville Powerhouse 1 in Oregon and Powerhouse 2 in Washington. The work consists of procurement and delivery of all components of a clean agent fire suppression system for each oil storage room. The proposed action will contain a brand-name description to specify a particular brand-name product peculiar to one manufacturer in a portion of the acquisition. The particular brand-name product to be specified is a fire suppression fluid created by 3M (3M Corporate Headquarters, 3M Center, St. Paul, MN 55144-1000) known as Novec 1230. No other fire suppression fluid is compatible with the fire suppression system to be installed in this contract, therefore, the use of the brand-name description in the acquisition is essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. This brand-name fire suppression fluid is commercially available from various suppliers. The statutory authority for this acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 6.302-1(c), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, application for brand name descriptions. The Government intends to solicit this action on or about 30 August 2019. The NAICS code is 237990, Other Heavy and Civil Engineering Construction. The size standard as defined by the U.S. Small Business Administration is $36.5 million. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR BIDS. Interested concerns must show clear and convincing evidence that competition of this portion of the requirement would be advantageous to the Government. All responsible sources may submit a capability statement, proposal or quote to the contracting officer before the notice end date. If no affirmative written responses are received by 10:00 AM Local Time on the notice end date, a solicitation will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government to include the brand-name product in the solicitation is solely within the discretion of the Government.
