Quotes shall be sent to: deborah.j.glass@uscg.mil Please indicate HSCG38-13-Q-300033 in the subject line of email. Secondary point of contact is Claudette Y. Surrento, Contracting Officer. Claudette.Y.Surrento@uscg.mil SIMPLIFIED ACQUISITION PROCEDURES (SAP) JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION, WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT'S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION: 1. PURCHASE REQUEST OR REQUISITION NUMBER 3023-HD04 2. PROJECT/TASK NUMBER C-130 LRS-S 3. ESTIMATED AMOUNT (OVER $3,000 BUT NOT EXCEEDING $100,000) 4. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE. Purchase for 2 ea Inmarsat Antennas. The Inmarsat Antenna was designed and manufactured by Ball Aerospace & Technologies Corp. (CAGE: 13993), PN: 513738-519 and is used on the Coast Guard's HC-130J aircraft for secure, over the horizon, communications (AirLink System) . 5. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED. The Inmarsat Antenna is an integral, mission essential, part of the HC-130J aircraft's AirLink System. In accordance with Technical Order (TO), 1C-130J-4-93-70-00, this is the only antenna authorized for use in the Coast Guard's fleet of HC-130J aircraft, in this application. This is a commercial system and the government does not have the rights to the technical data, the software and hardware necessary to manufacture this antenna; only Ball Aerospace has those rights and equipment and they have not sold or released them to any other entity (ref. attached email). 6. REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES The AirLink System, including the Inmarsat Antenna, installed on the Coast Guard's HC-130J aircraft fleet was designed and manufactured by Ball Aerospace. Ball Aerospace alone holds the design and manufacturing data and materials necessary to manufacture the Inmarsat Antenna; furthermore, they have not sold or otherwise released this repair data or equipment to any parties (see attached email). The use of another antenna in this application on the Coast Guard's HC-130J aircraft is not authorized and would compromise aircraft configuration, safety and interoperability with the fleet. Ball Aerospace is the only know manufacturing source for the Inmarsat Antenna. 7. EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE. The Inmarsat Antenna design, manufacturing data is proprietary to Ball Aerospace. The government did not buy any of these data rights when the AirLink System for the Coast Guard's HC-130J was chosen and purchased. Therefore, the USCG does not have access to the technical data nor does it own the test equipment needed to repair the Inmarsat Antenna. 8. PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED. IF THIS IS A FOLLOW-ON ACTION TO A PREVIOUSLY COMPETED ACTION, SO STATE. The Coast Guard will maintain open communications with Ball Aerospace & Technologies Corp and will continually conduct market surveys to identify possible additional sources that may eventually receive the capability and authorizations needed to manufacture the Inmarsat Antenna. However, granting access to technical packages associated with this antenna is solely a Ball Aerospace business decision. The alternative for the Coast Guard would be to completely replace the AirLink System that is now installed and intergrated on the HC-130J aircraft, which would be cost prohibitive. 9A.
