The Nashville District of the U.S. Army Corps of Engineers intends to award a sole source contract to Vaughn & Melton Consulting Engineers Incorporated for specialized Architect-Engineering services related to the Blair Street Bridge Construction. As the current designer of record, Vaughn & Melton will be responsible for reviewing and updating the original design, providing engineering during construction, preparing field instructions, creating an operation and maintenance manual, and submitting a design documentation report. This sole source approach is intended to maintain design liability and avoid the duplication of effort and costs associated with a second firm redesigning the project. This procurement is authorized under 10 U.S.C. 2304(c)(1) and FAR 6.302-1, as only one responsible source can satisfy the agency requirements. While the government intends to proceed with Vaughn & Melton, it will consider voluntary capability statements, past performance data, and references from other responsible sources to determine if a competitive solicitation is necessary. Interested parties must submit their information to the designated point of contact by June 26, 2015, at 1:00 PM Central Daylight Time.

Full Description

This is a notice of intent to award a sole source contract to Vaughn & Melton Consulting Engineers Incorporated (V&M) for highly specialized Architect-Engineering (AE) services to review and update their original design and perform Engineering during Construction services in support of Blair Street Bridge Construction. This work will require the AE firm to review and update the completed Blair Street Bridge design, prepare Engineering Considerations and Instructions for Field Personnel, prepare an Operation and Maintenance Manual, and submit a Design Documentation Report. V&M is the current designer of record and in order to maintain this status they must perform this review and update. It is against industry practice for an alternative AE to assume liability for another AE's design and this sole source contract will allow us to eliminate any issues with a second AE assuming AE liability for V&M's design. An alternative AE would request a lengthy review to verify the original drawing, equivalent to a redesign and a duplication of effort. While USACE will perform much of this review and oversight to ensure it meets contractual requirements, if design changes occur the designer of record must approve any changes or else they are no longer the designer of record. It is therefore in the best interests of the Government to obtain the services described above by procuring from V&M. This procurement has been approved for other than full and open competition under the authority of 10 U.S.C. 2304(c)(1), Federal Acquisition Regulation 6.302-1- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Federal Acquisition Regulations allow for the submission of capability statements from prospective offerors showing interest which shall be considered by the Nashville District U.S. Army Corps of Engineers. This is not a request for capability statements, proposals, bids, or quotations. However, the Nashville District U.S. Army Corps of Engineers will consider any capability statements, proposals, bids, or quotations submitted by all responsible sources. Depending on the evaluation result of the capability statements, the Contracting Officer will determine if this sole source action is justified or if a solicitation must be issued to interested firms. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No requests for capability briefings will be honored as a result of this notice. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. If you choose to submit information, please provide past performance and references regarding your ability to provide this Architect-Engineering service along with your statement of capability. The Government will not award a contract based on the information received, nor reimburse participants for information they provide. Information provided is strictly voluntary. Please email capability statements or proposals to contact@example.gov. Telephonic inquiries will not be honored. The closing date for submission of capability statements or a proposal is June 26, 2015 at 1:00 PM Central Daylight Time.
