Crack Sealing Program

The Corporation of the City of Niagara Falls is seeking bids for its Crack Sealing Program under solicitation RFT - MW-OPS-26-24. The project involves routing and sealing approximately 20,000 linear metres of pavement on city roads and facilities, utilizing the overfill method for roadways and the flush fill method for trails in accordance with OPSD 508.010 and OPSS.PROV 341. The initial term is scheduled to commence in October 2026 and conclude by December 31, 2026, with the City holding an option to extend the agreement for two additional one-year terms. Awarding will be based on the lowest compliant bid's stipulated subtotal contract amount. Contractors must adhere to strict operational constraints, including working Monday through Friday from 8:00 AM to 5:00 PM, and operating only when air temperatures are 5C or higher and asphalt temperatures are below 50C. Work in tourist areas will be scheduled at the discretion of the contract administrator to minimize traffic interference. Key requirements include a prohibition on subcontracting, the provision of performance and labour and materials bonds each at 50 percent of the contract value, and compliance with the Occupational Health and Safety Act and AODA guidelines. The contract includes a one-year maintenance period following completion and stipulates liquidated damages of 1,000 dollars per day for delays. Payment terms are Net 28 Days, requiring a proper invoice accompanied by a payment certificate, WSIB clearance, and updated insurance certificates.
